Town of Hempstead fence laws?
My DH told me he heard that you cannot have more than a 4 foot fence by your sidewalk. does anyone know if thats true? We have a corner house and plan on putting a pool on the side of the house and extending the fence to the sidewalk.
I just made a crappy diagram of my land. The dotted line is where the fence will be. TIA!

Not sure what the County laws are, but there are also town laws, village laws, and even area rules. What may be allowed in one area of Nassau may not be allowed a few blocks over....

That is true, we are on a corner and our fence is only 4' on one side of the yard. You can apply for a variance for a larger fence but it might be denied. And if you put up a taller fence without a permit and they catch you they can rip it down, it happened to one of the houses around the block from us. They had to get the variance and then pay to have it put back up again.
But I think the code varies by town, it's not set by the county. We're in Town of Hempstead, I called the Building Dept and they sent me what the rules were.

you have to check with the town cause each town varies.
most will limit height at corners due to site lines for cars

thanks! but im putting the pool on the other side of the house, not by the street corner. would there be an exception since its going up near a pool? i'm in town of hempstead.

You'd have to call. It's been a few years since we put ours up, but it was really specific about how far back from the sidewalk it had to be for corner houses, mid-block houses, height of fence, all that stuff. They even had diagrams

I think you should really contact your town for the rules regarding putting in a pool and a fence. Each town is very different. You might need to have a fence around your entire pool.

def. check my BIL has to take down entire decking and fence because he is being fined because it extends from the front of the house. Your backyard is from the front of your house and back anything in front of your house is a front yard which then most likely you will only be allowed to have a 4ft fence. Corner houses are tricky that way.

Hi,
Your diagram is exactly the way my property looks like. Did you get a fence up? I am in the process of getting a fence installed but don't know if I should go with the 4ft or 6ft.
