I also work for a small company. When my co-worker got pregnant, there was no precedent. I got pregnant shortly thereafter and we worked together to create a policy based on what is competitive in my industry. However, at the time our maternity leave was "At Management's discretion", so in theory they could have treated us very differently.

Since then, we have established a policy of 3 months paid and up to 3 months unpaid after a year of employment. However, the 3 months unpaid is still at Management's discretion so while one employee may be able to take 6 months, another may only be able to take 4.

It is very stressful! Hang in there!!

I am not sure how they are determining her leave time, but I did work for the county and the Maternity (NOT STD) was you earned one paid week for each year you were with the company.

With a company that has less than 50 people there isn't any mandate on what they HAVE to do. If you have a STD policy you would be entitled to 6 or 8 weeks at a certain percentage of your salary. There are companies that have salary continuation during leaves based on length of service and that is legal.

only thing required is FMLA - companies with 50+ employees are required to hold your job for upto 12 weeks if you've been there 1 year...

STD - is very small. Companies in NY are required to maintain that disability coverage.

Elective short term disabilty - either companies pays into and tell you its a perk - or they offer you can buy it through your payroll deductions - usually is 60% of salary for 6 of 8 weeks - not required.
