Issues with Neighbors. Is there anything we can do?
My neighbor has a legal apartment in her house. I love my neighbor she is an elderly woman. Her husband died a few years ago and she started renting the apartment to help financially. We have never had a problem with the people she rented to. My neighbor is trying to have her tenants evicted but it's not easy. In March she rented to a young married couple. They wanted to buy the house from her and she wasn't interested so they got mad. They had the wife's parents move in and they watch their 3 grandchildren all day. So now in the small one bedroom apartment there are 4 adults and 3 small kids. No one goes to work that I see. They stopes paying rent in June. Here is what drives me crazy. They stand on the deck next door and watch myself and my children in our pool. Sometimes they stand our there for over an hour. At first they would wave and have the kids ask us if they could use our pool. I was polite and waved back and said no. I don't want people in my pool with me that I barely know. They let kids out in the yard and they scream and fight. Yesterday the 2 boys screamed help me for hours. At first I ran outside because I thought something was wrong. Nothing was wrong other than they were trying to jump our fence. My pool is locked and alarmed but I'm afraid they would jump in and drown when I'm not home. I have no idea if they can swim. The grandparents argue so loud out front I can hear them inside with my ac on. I guess I could call the cops for a noise complaint but I don't know what that solves.

Call the cops. You can also call child protection if you think the kids are at risk because no one is watching them.

I would call the town you live in and file a complaint. In a legal apartment of that size, you cannot have that many people living there.

I would call the town you live in and file a complaint. In a legal apartment of that size, you cannot have that many people living there.
This. There is no way that a 1BR can legally accommodate 4 adults and 3 children. File a complaint with the town in which you reside.

The 3 kids don't live there. They go home at night. I'm going to call the town in the morning. I know my neighbor has already called the cops trying to have them kicked out. I feel awful for her.

Gotcha.....that's still above the occupancy limits for a 1 bedroom apartment though! I would still call the town.

I would ca the cops. The more the cops are called on them the better it is for your neighbor.

Is there a lease ? Check it for the occupancy limit. They have not paid rent in months, which would also violate the lease. Best thing would be to go to an attorney and start eviction proceedings.

Have you gone over and spoken to the adults yourself and expressed concern about the kids trying to climb your fence?
At least try to speak to them in person and tell them that you don't want the kids to get hurt trying to climb a fence and especially want to make sure they stay away from the pool. Make it more of a concerned parent thing, parent to parent rather than an annoyance at the kids being there, or loud arguing etc.
if that doesn't work, then at least you tried before calling the cops on them (because i'm not sure what the cops could do about the kids anyway.. they'd be more concerned with a noise complaint or if they're being abused, or if there are illegal tenants)

But they're not paying rent. Plus it sounds like she only rented to 2 people and those tenants had the others move in with them.

Is this on LI? Because there are not many towns where these apartments are actually legal. My next door neighbor has an apartment on her second floor, its beautiful and meets all the building codes, so its legal in that regard, but in our town, accessory apartments are illegal anyway. Have you tried the town?
