I recently got swindled by Star Exemption Advisor. We refused to pay so he took us to small claims. Got in front of the Judge, told the Judge why it should be dismissed including that it was intentionally misleading, showed the envelope that it was sent in which has the Nassau County assessors office on it. Arie Gal who represents himself in court as Arie Gal DBA Star Exemption Advisor (Interesting how he does not write that as the name on the contract or literature he sends us?) swore he does not use such an envelope, however did not show the court what type of envelope he uses. He just shows the signed contracts and walks the court though the steps he took to get the paperwork files and make sure he dotted his i's and crossed his T's, but never justified his price.
Anyway Judge said he reserves his decision after hearing both our arguments. Two days later we get a notice from the court saying the judge granted the plaintiff his suit and we owe all the money + interest and court fees. No written explanation of the Judge's decision and why the law supports it.
We could sit here and ***** and moan about guys like Arie Gal, but the reason they are in business is because the Judges in Nassau county uphold them. There is a reason why you don't see people in the boroughs getting duped by STAR exemption scams, its because Judges in NYC dismiss these cases with prejudice.
Perhaps, what we as taxpayers of Nassau & Suffolk county should demand is that Judges who uphold these scammers without even the courtesy of giving the families who have been defrauded by them a written explanation of how the Judge managed to contrive the law so as to render such a decision, well then we should demand of our elected official to get rid of such Judges.

FYI... This judge is up for re-election, in case this may sway your vote one way or another. As soon as I saw his campaign posters I immediately thought of this.
The judge upheld a contract that this person signed. Unfortunately, a judge can't account for buyers' remorse. In all these cases, it seems that the homeowners could have avoided this fee by filing themselves and reading their applications carefully. They did receive a service; whether or not it was a valuable service or something they felt that they were overcharged for is not for the judge to decide. It is unfortunate that people feel they were scammed, but it is unfair to paint a judge in a bad light for upholding a contract that, like it or not, they DID sign. [/QUOTE
It's not quite as simple as that - contracts aren't automatically as ironclad as you may think. A judge can absolutely declare a contract null and void if they determine the contract is unconscionable. I am an attorney and practice almost exclusively in breach of contract cases, and it's my personal opinion that this is a scam contract designed to prey on people and that the judge should have recognized that and not upheld its validity. But like I said, it's up to each individual who to vote for, and I'm not telling anyone who to vote for or who not to vote for - just wanted to point out that if this troubles others, they may wish to be aware of that come Election Day.

Guys--I'm just going to say this generally and not reply to any one person. The "legal advice" some are getting on here that there's nothing they can do is not necessarily right, free of mistakes, or even necessarily coming from a competent lawyer or anyone with any legal knowledge.
Consult with a real attorney. See what your options are.
ETA: I HOPE no one proclaiming that there's no recourse so definitively on here is an attorney. Because to the extent that you're wrong in any specific case--it's malpractice.

Can anyone recommend a lawyer that they personally used and liked?
I'm not sure where to even look for a lawyer or what kind of lawyer this matter would need.
Does anyone know how much they typically charge for something like this? also do they represent u in small claims court so you don't have to take a day off work?

This whole thing is insane!! Yes it is a legal doc some people have signed. But it is a total SCAM. And that the judges are upholding this just shows how corrupt NY is.

Unfortunately it seems like judges are upholding the contracts you signed, so hiring a lawyer would just add to the expense you would ultimately owe.
It really sucks. It's a total scam, but based on what a lot of posters are reporting you won't win so IMO don't hire a lawyer.

My advice, if you are going to hire a lawyer, is to hire a litigator. You are going to need someone who can talk and make a point since you basically go into a mediation room win a judge and Ari, who represents himself because he is pals with everyone in the local judicial system. I also suggest, if you're up for it, request that it go to trial. I think a jury is the only way he will ever be called out on his BS. is he taking you to court for payment or are you taking him to court? If you are taking him to court then that's a horse of a different color. You may have a better shot.

I honestly can't believe this scam is still going on. We need to warn people who buy new houses in our neighborhoods. I feel like it's the only way to combat this. Make fliers and hang them up, put them in mailboxes etc. it's bonkers that this crook is raking it in hand over fist.

I had a lawyer friend of mine suggest me to go on my own with the hopes that they knock down the price a bit. 1456 is what I owe this peice of garbage. Being a new home owner I don't have that money to spar.

people can be so mean sadly i got taken and filled it out.whats even worse my lawyer told gave me the paper to fill. Now im getting letters saying i owe them 1226$. im dont have that kind of money laying around. is the state really gonna let this scam go on? would i really have to waste work and pay out of pocket for a scam? im raising my child and taking care of my parents this is too much

We love many things about our street and community but currently we have been dragged into a terrible situation and need your help.
My wife and I received a letter from Mr. Arie Gal of 1936 Hempstead Turnpike, East Meadow, NY 11554. It stated that we signed a contract with him and gave permission for him to be our 'Star Exemption Advisor'. The letter included the alleged contract we “signed" which looked horribly forged, to me it looked as if he copied and paste the signature from another source. We also knew that we personally filed for our STAR exemption paperwork and still have the copies of the correct paperwork so naturally we discarded his letter.
This week on 3/10/2016 we received a letter from small claims court asking for judgment in Mr. Gal’s favor for $1,180.02 plus court fee’s and a court date of 4/13/2016. I searched a number of online forums and found dozens of similar stories from residents all over our community. This seems to be a very regular experience for new residence of the town of Hempstead and nothing seems to be being done to stop him and other career scam artist praying on our community. Why hasn’t this scam artist been shut down? What is being done to protect our community from Mr. Gal and others like him? What can I do to help and more importantly what can our elected officials do to help?
I hope we can talk this week via telephone and that you can get me in touch with the right person to end Mr. Gal’s scam.

he's probably getting signed copies of documents and affixing signatures to look like yours and then filing in small claims court and sending your notification to a bad address. Have you tried to contact the NYS Attorney General or your DA's office?

IDK, that's pretty far fetched. This guy makes bank on people that just don't read what they are signing. This thread alone is proof of that. I seriously doubt he'd be forging signatures and taking people to court over it for the thousand or so he's trying to collect from people. The guy is taking advantage of people for sure, but what he's doing isn't breaking the law (maybe that will change).

Agreed. That would be pretty DUMB on his part. Would be considered fraud and would lead to definite jail time. There is simply no need.

Why don't you just call and request one? After I received my "invoice" I called to see if there was some way we could work something out and got no answer (after sevearl tries). Then I left a message saying I was interested in the company's services and got a call back pretty quickly. Could that work?

We are in the process of buying a house so I am sure we wil get one of these in the mail. I want to be super vigilant that I do not sign anything. Does anyone remember what it looked like, who it came from? Just don't want to have this happen!
