Feel bad for my sister - help!
My sister and her husband are in contract on a house and the sellers have been ridiculous and unreasonable from the start. Their on or about was 8/25, then they had a tentative closing for 9/23. The sellers have been ignoring the lawyer and any calls or emails, and today their lawyer tells them the sellers can't close until 10/10. My sister's rate expires, they incur penalties, and have to resubmit all the mortgage paperwork. They are living out of boxes with a 6 year old a 2 week old! Their lawyer sent them an ultimatum email but really, WTF is wrong with these sellers? I really think they are trying to pull one over on my sister in some way - they are moving to FL and I think they are trying to avoid closing because they will have nowhere to go until their other place is ready.
I feel so bad for them.

can they offer to close and "rent" to the sellers until 10/10? I know it's still annoying and it doesn't solve them living out of boxes but at least it solves them resubmitting their paperwork, losing their rate and incurring penalties

My sister is not pleased with that idea but will do that if it comes to it - but they have not been forthcoming with ANY information. I think they just don't want to have to pay to rent the house after closing - they are being complete f%ckers!

I was going to suggest the same thing. Money is held in escrow got your sisters protection

Is there a penalty written into the contract if the sellers miss the 30-day window? She needs to ask her lawyer what protection they put in place for her.

Basically, they sent the ultimatum "time is of the essence" letter. Their lawyer said they must close by 9/30 or the buyers will have to pay for my sister to extend the rate, etc and my sister take possession. Or they can close 9/30 and pay the per diem until 10/10.

Ridiculous !!! Hope they comply. Still be kind to them because they could do some damage while in there out of spite. I don't trust people.

I was in the same situation when we bought, sellers dragged out the process because they wanted their daughter to finish out the school year... we ended up closing only because lawyer put a must close by date in and we closed with money still in escrow due to a fence CO issue they never resolved. I know its a giant headache, hopefully they close soon.

I'm trying not to be the bitchy older sister and say "I told you so" but I think this deal has been doomed from the start.
