Can a Merchant Charge a Sucharge to a Credit Card?
Sooo wondering this. Today, I was buying food at a Bagel Store in Commack and as I was about to pay they told us there's a surcharge to use a credit card. I know some places charge a $10 minimum, but I've NEVER been told there's a surcharge and now I'm wondering if there always is and most merchants don't say and I never noticed, or is this illegal? It's not the $ I'm mad about whatsoever, just the principal of it all.

Gas stations do it all tbe time... hence why you pay more per gallon for credit....so it must be legal I would guess

I know that gas stations definitely can't. They don't charge more for CCs..... however they *can* legally give a discount for cash...

It is usually against their contract with their merchant services provider to do that. I think some places get around it by saying there is a discount for cash purchases.

Oh Yes I remember there was some big to do in Newsday a few years back because some stations were charging over $1 more per gallon for credit and they said well it's a cash discount.

I’ve seen a nail place do this. If you used your cc, you had to pay an additional $1 for the fee.

I’ve seen a nail place do this. If you used your cc, you had to pay an additional $1 for the fee. This. My nail salon used to do it when they first took credit cards.

I have never come across this but if I do, I will no longer shop with them. It’s insane. As a merchant, you have to pay for the ease of credit cards. Not the customer.

yes it is legal now. this was changed a few years ago. i have been at vendor fairs and stuff where people use the square swipe things and if i need to pay with a card they add a fee. businesses lose a %age of the sale when they take credit / debit cards and they are now allowed to recoup that.
same with using paypal, Etsy, etc. if you are a business and use it, you lose a %age of your money to the merchant processor.
I dont personally do that, but write that off as a business expense come tax time.
