This kind of all sums up how I feel. They send him to the office, I told them that is what he wants, you are reinforcing the behavior. Their response, we don't see how that is possible. He has to do work in the office. Yes I get that but he is doing it on his terms, no transitions, no rules, no one around him. The first time they sent him home, they told him I was taking him to the dr for a psych eval. Yes they told my 6 year old that he was being taken to the hospital as punishment for bad behavior. And then the next day when I called the psych out on it, she said I never said that, you are misinterpreting what I said. I was standing there when she told him that I was taking him there and immediately told him I was not. A dr visit is not going to be a punishment ever. Several times over the past 18 months I have asked them to stop referencing his medication. They continue to do it. EVERY SINGLE TIME I TALK TO THEM. Even though I have stated several times that they have no legal right to know.
Out of curiosity - what would you like to see them do?
Unfortunately the teacher has a bunch of other students so it is probably not that possible (or fair to the other students) to spend more than a couple of minutes trying to calm him down or change his behavior. Maybe once he goes to the office he does calm down? Sometimes removing them from the situation is the best and only way to get them regrouped.
But I agree 100% that students that put their hands on another student gets a call home and gets picked up. The school HAS to have a 0 tolerance policy on that - weather you think your child is only getting what he wants or not. At that point, its not only about your child but about the other child as well.
He also has a 1:1 aide who is there to implement his BIP and assist him through the day. It is her job to aide him when he is acting out. The classroom teacher is not required or expected to do it.
What type of training does the 1:1 have? I’m quite surprised that they haven’t mentioned out of district placement if they cannot maintain his behavior. I would refuse to pick him up. He has the right to a fair and appropriate education which would be out of district and sending him home is the easy way out. I agree they cannot have him in school becoming aggressive and hitting but they also just can’t send him home. I would first: document ALL correspondence via email and if it is verbal or by phone, send an email directly to that person you spoke to to reiterate the convo It’s summer so if he doesn’t have summer school, or even if he does, contact your department head of special education. Request a new FBA and BIP. Once he BIP is inserviced ask for one month of data from before the BIP and after the BIP and ask for the data to be graphed so you can easily see a change. In that time, if possible make no medication changes but document and communicate any changes so the entire team is aware. If there is no change in a positive direction pre and post BIP revision, request another CSE and ask for out of district placement and don’t back down. Hire an education advocate or attorney because your child and ALL the kids have a right to an appropriate education. If he is in the office no learning is taking place. I didn't read all of the responses, but it sounds like he is in the wrong placement. I would call a meeting.
ETA and I would be really angry if they kept sending him home- that is only reinforcing his behavior that if he acts up, he can go home.

He is in ESY right now and doing well, but that is to be expected because there are no demands placed on him. We are going to have to see what the school year holds. I have spoken to the CSE chair and she completely understands all of my concerns. I have requested that we look into an alternative placement, more suited for behavior kids. But she refers me back to the school psych and we spin our wheels. UGH so frustrating.

Behavior in school
This drives me nuts - schools that claim to be able to meet needs of special needs kids and they really just don't know what to do. I found a list of these recommendations on line - maybe someone can give you some free advice and point you in the right direction so you don't have to keep spinning your wheels. So sorry you are going through this!!

Behavior in school
My son went to Boces for summer and it was crap His behaviours worsened a lot - hugging , genital fondling Toilet accident and being without footwear The teacher actually messeged me saying that I shouldn’t send my son on trips if I knew he wouldn’t do well She then asked for an aid and got a one on one with him and still sent me the same message It was a terrible experience for me compared to in district teacher So def research school and also teacher where ever you go
Maybe because it was summer school they had a not so great teacher I don’t know
