Does. Swing set need to be included in the sale of a house when you move or would you specify in the contract?

No it does not need to be Included.

If you are the seller and want to keep it, or the buyer and want to have it, it would have to be specified in the contract.

When we bought our house it was not mentioned in the contract. We didn't care about it either way.
The sellers tried to get us to buy it right before closing.
We said no, the sellers said they would donate it to a school.
It was still there when we closed because they thought it would be too much of a pain to move.
If you want to take it, I would put it in the contract to avoid any potential hassle.

If you want to take it, make sure your agent knows. Waiting until you're going to contract is too late to discuss it, IMO. It's a minor thing, but not worth the hassle of arguing over it later.

When we sold our house, we left it. It would have been more of a PITA and $$$ to move it.

You would have to include anything that you wanted to take in the contract. The old owners of our house wanted to take a chandelier and a mini fridge and they put it in the contract.

If I were to move, I would probably just leave the swing set there b/c honestly it would be a pain to take/move.

Was the set expensive and what is the condition? I know a school had one that was 10k and to move less than 5 miles away cost 1k. Not sure if there would be additional charges if things were rusty or needed to be replaced.

When we put our house on the market we specified that our swing set was not included. It was less than 2 years old and cost a couple thousand dollars. We paid a couple hundred for it to be taken apart and a couple hundred to put it back together. Way less than it would have cost to buy a new one. It went on the moving truck with all our other stuff.

Anything you want to take that is not a personal item, you have to put in the contract and should be on your listing. We had a problem at our walk through because the seller took down every light fixture and took the entire expansive home security system (closed circuit with a ton of cameras) in the house as well as a few medicine cabinets. The light fixtures I could have cared less but you can't just leave a light bulb in the ceiling, you need to replace the fixture. Same with medicine cabinets. The security system was a fight but they ended up paying us full cost of the system to take it because it was technically part of the sale.

As others have said, it's not a big deal to take it (I would say most people don't because of the cost of moving it).

But you must be upfront about it - I put any exclusions like this on the listing itself and make sure that whoever makes an offer is aware of them (as we negotiate).

You don't want to wait until contract because, at that point, things should be fully negotiated and buttoned up. It should just be memorializing the terms of the agreed upon deal, not changing them or adding things. That's when people feel blindsided or misled, even over minor things, and it's hard to get the deal back to a good place after that happens.

We took ours when we moved. It was an expensive set from Wood Kingdom and in great shape and our kids were still little enough. It was stated in the contract that the swing set was not staying. We then paid Wood Kingdom to come and take the set down and set it up at the new house.

On the flip side the first home i purchased had a swing set and i wanted it removed. I put that in the contract. At the time i didnt want it left in my yard.
