What would you do?

Looking for your opinion ….

I have a contract with my Landscaper to put down Red Mulch, we also discussed on the phone a couple of times that I wanted Red Mulch, I came home last night and there was Black Mulch.


I called the landscaper last night and left a message for him to give me a call.


This morning I get a call from the office manager (possibly his daughter) saying that they received my message and the "guys" must have mixed the order with another address and I got black and I guess the other house got red.


She said that "Next year if I want red they will not make a mistake"

I told her that my contract is for red mulch and that because of their screw up why should I have to pay the $140. I was told red and black the same price.

My boyfriend feels I should not pay since they messed up.

I more upset that the landscaper himself didn't call to apologize and try to work something out.

Landscapers are a dime a dozen in my neighborhood, what would you do?

I wouldn't be paying. They broke the contract.
Let them take you to court.
They need to come back and fix their mistake.
I am sure the people who got red instead of black are furious too- I would be.
They screwed up, you are the customer- come fix it or you don't get paid

I think it's a mistake, and I would be upset. But in the end, they did provide you a service and materials, even though it's the wrong materials!

I would not expect the Landscaper to give it all to you for free, but I would expect a discount. I'd call again and ask to speak to him.

I have a call into the landscaper waiting for him to call me back. I agree with you that he provided me with the materials and the labor, however we discussed the red mulch a few times so there shouldn't have been a mistake.

With that said, I would pay a portion of the charge but I don't feel I should have to pay the entire amount. His error and I so wanted red mulch this year!

I would expect them to fix it to red. I wouldn’t expect a full refund but they need to figure out how to make you happy, a promise of next year isn’t sufficient.

I agree with you about a portion.
This is why I hate having things done. The stress over this- because someone didn't care to get the mulch right or ask you first if black is ok

Its not what you paid for, I would either want them to redo it (and I'll pay full price) or keep the black at a 50% discount.

I’d want my red mulch. What kind of business doesn’t fix their mistake?

If they won’t give you what you ordered, their promise of red next year would be meaningless because I’d be using a different landscaper next year.

And honestly, the more I think about this, I don't care that they "performed a service". It was the wrong service.
So with that line of thinking if I hire a guy to redo my kitchen and instead he goes up on the roof and replaces my roof, I should still pay him for replacing my roof? Because he performed a service? Even though it wasn't the service I asked for?

What would you do?

We had something similar happen last year. We have a ton of mulch around our yard but I wanted stone around the pool and the sun room instead of mulch. In the contract and paid for. They mulched everything. I had them come back, dig up the mulch and put down the stone. I paid the full price but they had to fix the mistake. Make them fix it and then get a new landscaper.

You are right, I shouldn't have to pay for their mistake.

The funny thing is that in the town my boyfriend lives in gives black mulch away for free, I of course wanted red and was willing to pay for it so that is why I went through my landscaper. Lesson Learned.

There is a huge difference between red and black mulch. The appearance is not at all even close. I would call back to the landscaper and give them 2 options; 1 - replace with the proper mulch and you pay the full amount or 2 - keep the black mulch at no charge. At the end of the day, they did not provide the service that you contracted with them for.

Years ago we had sod installed. Let's say we needed 1000 SF. And the installer gave us a quote for installation of 1000 sf. But the day of, only brought 500SF. Somehow, he had managed to miscalculate the footage (by a lot). He had to order more material and come back to install. And at the time, he actually asked us if we made our yard bigger because maybe that is why he was short. Like a serious question, not kidding. Anyway, we did not pay any additional for the material that he had miscalculated or the time to come back for the installation. Now, we know why his price was so much lower than everyone else ( by about $1500). Because we only paid for half our yard.

I agree, or come and fix it and replace it with the red, which is what you wanted

And by fix it I mean either a 50% credit for the color I didn't want or change it to the color I wanted.

Thanks everyone for your opinions/advice. The fact remains the same, I asked for a service and that service was wrong. I am still waiting to hear back from him, if he is a good business man he will make good on his mistake.

I would not pay for the black mulch. They come come and remove the black mulch and put down red and then you will pay for it.

Fix it, or greatly discount it!

Would people feel the same way if they painted your house the wrong color?? I don’t care if you used time and provided a service...you did it incorrectly! Fixing mistakes is a cost of doing business— if you want to stay in business.

I agree that they need to come back and fix their mistake or there should be no charge to you.

Same goes for anything - if your colorist made you blonde when you asked for brunette you wouldn't accept "oh well next time it won't happen."

We had a landscaping issue last year. We did not agree to a service that they performed and tried to charge us for it. After they refused to issue a refund we stopped payment on the CC.

While it was an honest mistake the way they handled it led us to use a different provider this year.

Mistakes happen, but the way a company handles the mistakes is what determines if they keep a customer or not.

I would keep the black since red mulch leaches dye into the soil. I would expect a discount. I don’t believe it’s feasible for them to completely switch out the mulch. If they give you a hard time about this and don’t offer a reasonable solution I would not use them again...
