If you get a notice from Unemployment that your old job is protesting your benefits what can you do?
I had written a while ago about a friend who's husband got fired from his job - due to him being late. They'd given him warnings, and now are protesting his unemployment.
Is there anything that can be done?
I dont' think there is..but I figured I'd ask because she is a MESS!

Unfortunately, I dont think so. His ex-employer will most likely keep denying/refusing it especially since they have reason.

I know in Cali you can request a hearing with the EDD. The employer will show up and fight it if they feel it's a good reason like being fired for attendance problems.

He can try appealing it. I'm sure the company has records of his lateness & would prvail on that alone, but you never know.

Thanks Ladies. I had a feeling this was the case. I think at this point, he should try for the hearing, and while waiting apply for retail or wherever he can just so that he can have some income coming in.

MY DH faced a similiar situation a couple of years ago and he appealed it and won. The employer did not show up.

no offense to your friend, but isn't it his fault for getting fired? As an adult he should be responsible enough to get to work on time.

ditto. i had appealed with a previous employer a while back and they never responded to the appeal. so i was awarded the UE.
it never hurts to try. good luck to your friend!

Like PP's mentioned he should try to appeal the decision. Was the lateness excesive? How long was he there? These are all things that he should keep in the back of his mind before going through with the appeal.

they can file an appeal. it will then go before a judge- judge has the final decision.
