Disability Guidelines Question...NYState

Does anyone know what that guidelines are for employees who are employed full time but have their compensation package switched to working 100% commission? Technically there is not an income until a client pays a bill so I'm a bit confused as to what the guidelines are. I'm asking in relation to NY State Disability for Maternity Leave.

I've looked on the NYS Worker's Comp site but cannot find a clear answer and figured I'd ask here before calling them.

Thanks!Chat Icon

The answer may be tied into whether you work on a 1099 independent contractor basis or get a W-2 Chat Icon .

I get a W2. Until last week, I was working on draw vs commission. The company switched everyone to commission only so I'm just curious to find out how this will affect my maternity leave disability since I'm technically not receiving a set salary anymore.

THANK you! I am stressed enough about what is going at work. It's nice to know I'll get a little something while in LOA. Chat Icon
