Yet another disability question
I am entitled to 14 weeks off. Here is the breakdown:
6 weeks Short Term Disability (begins at time of labor) 6 weeks Maternity Leave 2 weeks Vacation
All 14 weeks are full pay. If my doctor were to put me on disability before the baby is born, am I still entitled to 14 weeks AFTER he is born? I know I can use my 2 weeks vacation before the disability, but I might want to avoid doing that and ask the Dr. to put me on disability.
I asked the HR person but she didn't seem too sure in her answer, so I just thought I would get some insight from you ladies.

I am an HR rep and I deal with this all of the time. I do not know company policy so I don't know if the materinity leave that you are speaking of is FMLA or additional materinity that your company gives.
I am going to go by FMLA standards (12 weeks of security to hold your job-legally). FMLA starts the very first day that you are out and goes up to 12 weeks it runs concurrent with disability. So lets say you go out two weeks before you have the baby. You would get (not counted any company policy additional materinity leave):
2 weeks FMLA (and disability if your doctor deems you disabled) 6 weeks disability after you have the baby 4 additional weeks under FMLA and 2 weeks of vacation.
It's hard to incorporate the maternity leave because I don't know if you are considering FMLA as maternity which many employees do.

Thank you very much for your help
The Maternity Leave that is offered by my job is paid leave. And it does run concurrent with FMLA. But not all companies offer that additional 6 weeks paid, from what I understand.
So, basically if my dr. says that I am disables BEFORE the birth, that time will come off of the Maternity Leave, not disability?

No matter what after birth you are considered disabled for 6 weeks (V-Birth) or 8 weeks (C-Birth). The minute your doctor orders you out, you are disabled. FMLA begins the day you go out as well.
Most companies take it off of your maternity leave. If it's a matter of not wanting to work and it's NOT a medical issue, I would use my vacation days.
eta. this was my plan until my son showed up 6 weeks early. Then I had plenty of time...

Sorry top hijack....BUT what if you dont get any disability? Then all you get is the 12 weeks FMLA starting the day you go out?
I am part time at my job, I get no short term disability....I was wondering what Will happen to me...

As long as you qualify for FMLA, they're supposed to give you the same or equivalent job when you return from leave.
If you pay disability out of your paycheck, you should qualify. Many part-time employees do pay into NYS disability.

You may not qualify for FMLA protections either. If you've been working at your job for at least 1 year AND you worked 1,250 hours in the last year (and the company has at least 50 employees), you're entitled to FMLA protections.

Yeah, I worked Full tiem last year and my part time is over 1300 as well and I work for a very large company, so Im not worried about the FMLA, just getting some money during the time off.
