Recommend a Labor Attorney for Suffolk County

I don't even know where to start the search but I have a few questions about my company's policy. Specifically the lack of concrete information in their policy and procedure manual regarding FMLA. No where in their lengthy policy does is mandate FMLA to run concurrent with disability leave. Yet, this is what is enforced. Per the federal regs, an employee OR an employer has the option of running FMLA concurrent with other forms of leave. However, I would think that my company would state their position in their written policy. They do not. I want to know if I am bound by their written or their verbal word. I'm not a contractual employee....and I probably have to go by their word. But I wanted to call an attorney and double check. If you have any recommendations, thank you in advance. If you know the answer....even better!!!!

If their practice has been to run FMLA leaves concurrently with other leave types (as most companies do) then it would be considered their standard practice and you would have a rough time fighting it. If there is a published document that says otherwise then it's a different story.

You don't need an attorney for that question. Call the Dep't of Labor directly - they're very helpful.

Call the DOL...I don't believe a lawyer is nessary...

However, common pratice is that FMLA and STD run concurrently...

FMLA runs for 12 weeks and is an unpaid leave that protects your job and STD is a paid leave...

I agree. It's an employer's option if they decide that FMLA is to run concurrently with disability (including pregnancy leaves).

FMLA only ensures that you have that 12 weeks of leave available.
