Legal Question/FMLA Related
When must a company inform you that you will not be going back to your previous position? Is there a legal mandate to this or is it up to the discretion of the company. I know that your pay and benefits must be the same after returning from FMLA but the position may be different. I'm just curious as to when a company can or should tell you that?

I believe the requirement is that they must return you to that position. However if that position is gone, they must return you to a position of equal pay and benefits, but there is no time frame that they must tell you any of this in.
