Legal Question (Pregnancy & Career Related) UPDATE in 1st post
Ok so this can probably go on 3 different boards, but this gets the most traffic so hopefully it will help.
I received a letter that my name was drawn for a Police Dept job. I have to go through all of the background checks and a physical test.
Now I am 6 mths pregnant. I obviously can't do situps, and at this point I am lucky if I can run and do pushups. Once i have the baby, there will be no doubt in my mind that I can do the required physical part.
Do I have any rights as a pregnant woman? I called the office and they said I have to take it as is. But they doesn't seem right. My dr would not approve of me doing 32 situps in a minute. It can't be good on the baby.
Has anyone been in this situation? Can they discriminate against me at this point in time even if I pass everything else??
UDPATE:
I submitted a letter to civil service and I am allowed to carry on with the interview process and take the physical exam in August.

Re: Legal Question (Pregnancy & Career Related)
If it is a physical requirement of the job and what they call a Bona Fide Occupational Qualification (BFOQ) that anyone who does this job MUST be able to do the sit-ups, etc. then they are totally in their rights to say you have to.
Hope that makes sense.

Re: Legal Question (Pregnancy & Career Related)
Unfortunately, I agree with Leighla...you might have to sit this round out. My BIL is 1 year into the SCPD, graduated last March from the academy. They were put through the ringer for the tests AND the academy...granted, he had a nearly 2 year screening process to go through, but it was grueling none the less.

a 2 year screening would be nice lol. it just really stinks that I waited this long for it and its at the end of the list.

Call them and ask to be rescheduled due to a temporary disability.

Re: Legal Question (Pregnancy & Career Related)
i'm afraid you're going to have to defer the job right now. When they're hiring next, you'll still be on the list and you'll get another letter. So when that happens... just try for it then.

Sorry. when it comes to this... there's nothing you can do. There is no way you can bypass the testing. You just have to let this round go and wait for the next call.
