Smoking in th workplace
Has anyone had to deal with an employee violating the smoking law at work?
I have told this employee several times not to smoke in the buidling but i caught him again today. I told the owner who said he would speak with him but i dont think this employee will stop sneaking.
Can i call the police if i see the employee smoking? Technically its against the law - would they actually come and address the situation. I feel like if this employee got scared maybe they would stop.
Has anyone called the Suffolk County Tobacco Enforecemnt Unit? How do they handle the situation?

Sorry - should have mentioned this is a small company (7 employees)
This employee is related to the owner also - so i know the owners "threats" dont mean much

I have no idea how you would handle this situation. Maybe talk to HR about it. But why would ANYONE think that smoking inside is okay these days? This is not 1965, sheesh!!!!

Can't you threaten him with termination for not complying with a law?

I dont have the authority to terminate him and since hes releated to the owner - im 99% sure he wont be terminated

There is no overhang outside - so when it rains - he stands in the door way to smoke - but obviously it all blows inside

Would the owner have a problem with you threatening him with termination? I know the laws are the laws- but unfortunately when family is involved it can get messy.

IDK what you should do here.
Is it blowing into a vestibule or directly into the office? And there is NO where else he can go? How about to his car?

Yes his car is 20 ft from the doorway - which even the owner said is what he needs to do but hes lazy

For now, print the government non- smoking regulations and put them in your office and in the door. If that doesn't work I would follow up with your boss in writing. That way you can have things documented.

I was actually thinking of handing the printout to my boss and the employee with the warning that the county will be called next time.
At this point id take a chance with my job b/c if this doesnt stop i dont want to work here with second hand smoke

people smoke in the stairs here because they don't want to go all the way down to the ground floor. We are up high. But sometimes when people open the doors, the smell comes in. Its really gross.

has anyone else complained? If so, you can tell the person yourself - along with the owner, that epople ahve been complaining and it needs to stop. Does anyone in the office have asthma? This could also be brought up.

Then I would go full speed ahead. Document every time you mentioned this to the owner. After three times mentioning it to him, start sending him emails so there is an electronic copy. If it still continues, hard copy.
While you may worry about your job, the owner is going to have to realize two things:
Smoking is a real no-no and a disgruntled employee can cause him issues down the road. If you are terminated, you can easily call retaliation.
And the mere fact that you are in HR should make him realize that you probably know your rights.
I wouldn't tolerate this.
