Disability question
When going out on disability - can you still received your paid out vacation time from your employer?
On the disability form it asks the employer date employees wages ceased and if they are continuing to receive wages while on disability - but isnt vacation time different from wages?

In my office we have to use all vacation and sick time before going on disability. But you cant get both together. So if you have 1 week vacation time and 1 week sick time your disability wont kick in for 2 weeks. Thats probably what they mean by date employees wages ceased.

With my company you have to use 5 days of vacation time before you start getting paid out for disability. Not sure if you can use additional vacation days while on disability.

In my old job...I worked in HR/Employee benefits, and this was the policy as well.

Every company has a different policy. Some make you use up your vacation or sick time.
Our company doesn't. If you qualify (which is based on length of service), you get 100% pay for 90 days provided you have the medical paperwork to prove it.

my company doesnt have a policy and could care less if i take the vacation and disability together. But would disability know that im still getting paid from my employer the vacation time?
do they have any way of knowing this? And do they even care if im getting vacation time?

I don't think you can receive any money from NYS disability if you are receiving ANY money from your employer. We've had this issue w/people who were on maternity leave and were not able to receive their bonuses while on leave because it would have jeopardized their disability benefits (they received their bonuses after returning to work). Disability will know and/or find out if your employer completes the documentation truthfully. The easier thing for you to do may be to receive your vacation pay for however long you have (1 week, 2 weeks, etc.) and then go on disability.

No, you cannot receive both payments together. You get one or the other. If you are receiving vacation pay then you don't get disability pay until the vacation pay runs out.
Disability is usually informed by your company or your company's HR department. So they know when your payroll has ceased. The whole case is handed over to disability and the pay comes from them instead.
Yes they care if you are getting vacation time. They do not want to pay you if you are receiving payment already. Disability with my company comes from the insurance company... and trust me, insurance companies do not want to pay out.
With my job we had to use 5 vacation days and then you start the disability process. Being out on disability isn't fun at all though because the disability insurance company is notorious for making errors and paperwork errors, etc. Make sure you keep a file of every documentation you need.
