Asking for prayers for my brother
I rarely EVER ask for prayers but I could use any help we can get. This has been haunting my family for a month but I've been trying to be positive.
I don’t want to go into too much detail because well it’s the interwebz and all…
My brother Daniel was wrongly accused of some rather unfriendly things in South Dakota. Apparently that state has some strange views on law and guilty before proven innocent. He did nothing wrong.
His ‘crime’ was to drive friend A to the friend A’s house, wait and then leave with said friend. Also in the car was Friend B. Well friend A committed a crime and now they are after my brother. Two charges to be exact and both felonies.
I am very upset not only because its false but because he had moved to Texas recently to fix his life and get straight and find a job and start his life, fresh. He was yanked back because of a warrant for his arrest. I paid money to fly him home (money well spent of course). The bond was paid by my dad (he has so very little but found a way). My daughter is heart-broken that uncle Danny isn’t home and asks for him daily. It was literally MONTHS after the crime that the warrant was served. He was never charged with a crime back then.
He got back and they booked him and set his court date for 2/16. Just now the public defender called him up and said based on info the charges are not strong enough and made an appt to speak to the judge with my brother 1/23 to see if this can’t be settled..
Friend B supported my brother’s story in a written statement My brother’s written statement at the time of the crime also admits no wrong doing or knowledge of Friend A’s crime. They searched our house for clues or evidence of the crime and found none.
So I could use some prayers that this is all taken care of in our favor on 1/23. He’s a good kid trying to put his life on the right track. He left all he knew behind so that he could start a new life, the right way. We even had him a job set up to work security but this just ruined us. I need to get him back and help him work his way to a good life. He has so much against him. And although I love my Dad, no real role model or example of how a man should be or how a citizen of society should act. Well no one with the exception of me. I never realized how much he looked to me as the ‘way out’ until now.

yeah, unfortunately I believe the law is that if you participate before a crime (as in driving someone to commit a crime), you are considered guilty of that crime <nice friend!>
I hope he works it out

Sounds like your brother was an accessory to the felony by driving the get away car. I don't know how the law works if you were unaware of the intent of the crime being committed or the act itself. Regardless, it sounds like 'Friend A' wasn't really a friend at all. :shrug:

Sent money over good old Western Union to Iowa today to get him a new outfit so he's presentable for the meeting. Its *MY* request so I'm paying for it. I think he should look like a kid trying, and show respect to the offices he's entering, the importance of the circumstances and the seriousness of the situation.
Maybe my Dad was right when he told the DA I'm more strict that he is?
I can't wait for this to be over!
Ironically the meeting occurs on Chinese New Years.. the Year of the Dragon from the Year of the Rabbit. I am a rabbit and its a lucky sign and the year of the dragon is supposed to be a lucky YEAR. So I'm hoping this is a great end to my year and a wonderful beginning of a new year.
