We followed up with the pediatric neurologist today and DS was diagnosed with ADD without hyperactivity. She wrote his diagnosis and sad that we both believe there is no need for medicine at this point and that he will benefit from a behavioral assessment and modifications. I brought a copy to school, but is there something in formal writing I need to submit to have the school implement a behavioral assessment plan? I'm also going to request a 504 for additional testing time and having directions read to him. Can I find this form online?

We are the parents of XXX, who attends XXX Elementary in Grade 4. XXX has recently been diagnosed with ADHD (mainly inattentive), that directly impacts his educational performance and needs. Though the school and teachers have attempted to address some areas of concern, XXX continues to have difficulties, as many of the interventions have been punitive in nature. He is making limited progress and as a result is experiencing increased frustration.

To address our concerns we are requesting that XXX be considered for an accommodation plan pursuant to section 504 of the Rehabilitation Act. Thank you in advance for your collaborative efforts to provide our son with an appropriate and quality education. We look forward to your timely response and plan for meeting our requests.

We were denied a 504 plan on our first attempt because, although he was diagnosed, they told me it was not affecting "a major life function" (in other words, he is not failing, their words). After that, I requested full IEP testing, which included testing for learning disabilities, and a functional behavioral assessment. He did fine on the IEP testing, no learning disability, but the behavioral assessment is what finally got him approved for the 504 plan. At that point, though, his grades had declined and he was failing math.

I have found that some districts hand out 504 plans without a problem, others fight it.

Once you send the letter, they have 30 days to reply with a meeting date where you will discuss the issues. It can be quite intimidating.

Thank you so much! Did you also have to submit in writing the request for the behavioral assessment? I'm afraid they will fight me because DS does well academically, but I still feel there are helpful accommodations they can make.

I did not have to submit the request for the behavioral functional assessment in writing, they did it when they did the IEP testing. Some districts will give accommodations without having any academic issues, others do not. Make sure when you have your meeting, that you know what accommodations you are specifically asking for. They will ask you. If you get denied, request an IEP evaluation.
