Neighbors tree ruining my fence

My neighbors tree is causing damage to my backyard fence. It is leaning on it causing it yo bow into my property. I want to replace the fence but I want the tree gone first. Is it my neighbors responsibility to remove the tree?

You can't remove the tree without their permission, but I would think if you want it gone, they would want you to pay for it. (If they Agree to take it down). Or you can cut all the branches that are hanging into your property. That you really don't need permission for.

Don't just cut branches without checking your town code. Some towns you cannot cut even the branches without permission.
