I would just RSVP that you're not going to the party. I don't see why you would need to involve the teacher.

Thanks!! I was gonna do that but just bothered me to hear from DS he’s a mean boy and didn’t really think about it too much till I asked my son about the party.
I’ll leave it and respond no then.

Just a quick story - when my DS was in first grade there was this REALLY annoying boy (according to my son) we will call John. And every day he would come home and tell me all the mean/bossy/annoying things he did. It was at the point where I was going to ask the teacher to talk to John's parents. Anyway, for whatever reason John ended up inviting my son to his birthday party and we laughed - AS IF he was going to go! Surprisingly, my son said he wanted to go because all the other kids were going, and at the party all the boys had a great time. Fast forward 6 years later and John and my son are best friends and John's family is just lovely. Not that every story turns out like this and of course no big deal if you don't go to the party. But 5 and 6 year olds are just so little and half the time I don't think they mean to say and do certain things. Just a different perspective.

Kid probably thinks your kid is his friend.
Such a variety of personalities and maturity levels at that point...

Cute story. I know this boy and I know some moms who said the same thing though. I'll just respect his wishes for now and not push it. He's never said no to a bday party or playdate before.
Similar story to my older DS. In kindergarten and first grade there was a boy that was mean to him. In 2nd grade his best friend (who played football with the other boy) told the boy to stop being mean to his best friend and since then he's never had an issue with him. Love that story.
