Those with kids going back to school
How is your district handling special ed who chooses to be remote?
Our district is having a remote learning academy for gen ed, and then live streaming the regular in person classes for special ed. However, only the special ed children with have access to the live streaming, even though my child would be physically in the live streamed class. While the camera will be set to the front of the room, I’m concerned about privacy issues should my child need help, be disciplined, etc.
I feel as if normally, schools aren’t even allowed to post pictures of my kid without permission due to legal issues, but this is a much “bigger” deal.

In a normal year if your kid went to the teacher for help his classmates would see him walk up to the teacher. Same thing for discipline if he acted out. No one is permitted to tape the live stream or screen shot it. If they are found to do that they will be expelled and the penalty is to loose services.

My work district has said if you choose in person school, you are agreeing to have your child recorded. If you don’t want your child recorded, you need to choose virtual school.
Also, I would assume most recordings will only allow you to view the teacher or whatever they are presenting.
Live streaming is going to be a disaster.

Well, obviously. However, those kids in class don’t have their parents next to them.
I’m more perturbed that they are receiving access to my child’s class and I’m not able to.

I posed this question immediately when the plans were released. It is very tricky as they (government) decided that live steaming and zoom meetings were not covered under FERPA unless there were educational records being displayed or talked about. My argument is that if a child is having a meltdown and their behavior plan needs to be implemented then in fact they are using an educational record and in violation of FERPA. This is fully not addressed yet as they sent it to the lawyers.
What have done is for elementary, they are not live-streaming they will be in zoom classes like in the Spring.
For secondary - they are not going to allow live streaming in electives or special that include children with IEPs. They will just choose the other sections to live stream from. For core subjects, they are ensuring me that the teacher will have their computer with them at all times and will immediately shut off the live feed when a behavior occurs. Not happy with that but we haven't figured a work around for this yet.
We also had them add a remote learning code of conduct section so if anyone records or uses anything they see via remote or live streaming negatively towards any student or teacher it will be dealt with immediately.
