Why has there been radio silence from the left instead of the condemnation this action deserves? If you actually support what happened I’m interested in hearing your view.

Two things can be true at once. You can disagree with the idea of the power of abortion rights returning to the state AND realize how the leak puts the SC at risk.

As a lawyer who is admitted to practice in the Supreme Court, I am shocked, but not surprised, that for the first time in history a draft opinion has been leaked.

Shocked, because it has never, ever happened before. Not so much as a sentence has every been leaked before. Not surprised because both sides benefit from the leak.

The left obviously benefits because it has now motivated protests. It is also leading to calls for reform of the court, including drafting ethical standards, which have not before existed.

The right will benefit when a much less inflammatory version of this opinion is released, because then everyone can point to the leaked version and say "oh, it could have been much worse."

What is fascinating is what is coming out of the court in the aftermath of the leak. Roberts trying to uphold the statute, but not outright overturn Roe. Thomas' use of the word infidelity to describe the leak. In the general sense, most people think of cheating, but in the legal sense, infidelity (think Benedict Arnold) was at one time punished by death by firing squad.

Frankly, the politicalization (which IMHO is the reason for the leak) of the Supreme Court lies squarely at the feet of Mitch McConnell, who upon the death of Antonin Scalia used every political maneuver he could to prevent then President Obama from appointing someone to fill the seat. Within hours of Scalia's death he said “The American people? should have a voice in the selection of their next Supreme Court Justice. Therefore, this vacancy should not be filled until we have a new President.” Completely ignoring that the American people did have a voice, because they had already elected the incumbent. But then, when Ruth Bader Ginsburg died -and early voting was already underway, he managed to shove through Amy Coney Barrett in the shortest time ever for confirmation of a nominee.

IMHO, the Court started to lose its luster with what happened when Mitch McConnell refused to consider whoever then President Obama wanted to nominate. I saw whoever because I don't think Garland was his first choice. I think he picked Garland as the best non-controversial choice. That was when the rumblings started - this time. During the new deal era then President Roosevelt "threatened" adding justices up to a total of 15.

Anyway, so the court loses something when McConnell pulled his stunt. Then there was the Brett Kavanaugh spectacle. Whether or not he committed sexual assault, his demeanor during the confirmation hearings showed that he should not be sitting on the court. The rumblings got louder. Enter Amy Coney Barrett - yet another justice that shouldn't be sitting on the court. The lead to full out cries to reform the court. I think the fact that Biden recognizes that if he tries to add justices, the next republican president will add justices and so and so on, is the only reason the court stands pat at nine right now.

What is clear though, is that the court has become a political symbol.

Clarence Thomas' wife is waist deep in conspiracy theories and supporting insurrection, while he rules from on high without recusing himself. Not to mention the sexual assault allegations against him. Alleged sexual predator number 2 and Barrett wouldn't but for the machinations of McConnell. I think if Obama had gotten his appointment the way he should have, then Gorsuch would have been Trump's nominee (the seat now held by Kavanaugh), and Biden would have been able to appoint someone to fill RBG's spot (now held by Barrett - who isn't fit to clean her shoes).

It's a shell of its former self, and Thomas breaking his famed silence to say something about it is frankly hysterical (and ironic, and completely sad).
