I think I might know who the original poster is. At least the one who posted the exact law on the boards. I was friendly with her and we FMed several times back and forth while I was planning. She was an 05 bride but is now an 06 bride. Yes, she is a lawyer and last I knew practiced in NYC.
She is right. There is a Suffolk Co. law that states if you cancel with a hall more than 6 months before your booked event they must refund you all of your money minus $100. If you can get $4,900 back why not?
All you have to do is go to your catering hall with the law in your hand. If you cancelled with them 6 months before your date and have proof of that cancellation in writing (most only accept written cancellation) then they are legally obligated to give you your deposit back minus $100.

Don't wait. File now with consumer affairs, they are not that busy in January and February
it's two of the months they charge less for. How long does it take to write a check. Be strong and get your money back.

Make SURE they have not booked your date yet and are just telling you they haven't. I would have someone call and say they are interested in that date adn see what they say. I am always so skeptical of these places.

I did the same thing for a former co-worker of mine a few years ago. He had to postpone his wedding due to him and his fiancee both losing their tecahing jobs. The catering hall (can't remember which one) claimed they didn't rebook the date. I called for him acting interested and sure enough they told me the date for that room was not available Liar, Liar pants on FIRE!!

I filed w/ consumer affairs and a nice letter is being written to newsday...and news12....
I dont think people will take to fondly of these @ssholes trying to rip off someone who is overseas fighting for our country!

I think the hall is beautiful...and I believe they through a great wedding...BUT they will SCAM you the minute you no longer become their $$$

Good Luck! I just wanted to add. We had to postone a few months prior to our 07/05/02 wedding because the groom couldn't attend due to fact the USAF took his leave. Every single one of our vendors jumped thru hoops for us, holding deposits and rescheduling everything when he finally got leave again and with only a month notice we finally got married 09/27/02. Even our printer worked with us and gave us a huge break for redoing invites since they had the master and every vendor was right there with us. So not all of them are @ssholes sorry yours were. The difference might be that 9-11 was still fresh in their minds and before we booked they knew he was active duty since he was never around. We did end up paying for empty seats because our hall had too much money.

Iknow and I don't doubt it! I hate that they do this (I mean they all caterering halls) because it's a 'wedding' they get away with some much!
Laurie- that's great that they did that for you, I wish all vendors treated people like that- unfortunately most hear wedding and see only $$$$$

SO.... East Wind called me yesterday...to inform me...they DONT have to give me back the money BUT they WILL
(yea like they would give back the cash if they didnt have too....)
Of course I got the we're really busy speach SO... there not sure when I can pick up my check!!!!!! (Too busy to write out a check..???)
I already filed with consumer affairs...SO I told them they had til Tuesday ( by then Consumer affairs should have my paperwork)
If I cant pick up my check on Tuesday...then Im just continuing on with the whole complaint process... BUT if I can I will canel....
SO I guess we'll see what happens...either way Im getting back my money!!!!!

Just one more wedding related question.....Since the hall had to give me back my money.....does the same rule apply for vendors....
I have a photographer who has like $400...and wont give it back unless he rebooks the date

I'm glad that it looks like you will get your money back.
I would definitely persue things with the photographer as well. It's BS that he can't help you and at least do a sitting with the baby.
