I dont get maternity leave from my job, they only give me short term disability and even that is not at full pay. So I'm wondering if NY State will supplement my income...since Ive been paing disability insuarnce all these years that Ive been working, it seems that I should be able to use it when Im not getting fully pay from my company.
I just dont know how to go about finding out what Im entitled to.
ETA: Also, have a baby IS considered a disability so I dont have to come up with any other excuse.

Is short term disability the same as Social Security Disability??
Technically no. Social Security Disability is given for permanent conditions and is based upon how many years you worked and how much you paid into FICA. When my Dad had his stroke at 57 he immediately qualified for SSDI. It is a higher payment than what normal SS would have been because he needs extra money for his care. Had he not had the stroke he would have qualified (according to the year of his birth) for regular SS at age 62. His payments continue for the rest of his life.

By the way, I've definitely heard of friends being able to supplement their company's STD with state STD, so I think it's possible. If I can find out from them what they did I will FM you.

That makes sense - I wouldnt be able to get that but I think Im entitled to some kind of supplemental payments from the state - after all, isnt that what we've been paying for all these years every time we get a paycheck and disability is taken out?

You do pay for DBL or Disability Benefits Law but that for disability caused at a job. I would call SS dept and find out. I know that you can also contact the NYS Unemplyment office and they can give you information.

Same here. You need to find out if the short term disability your company has is private or if they are using the state's. When my friend went out on maternity leave, her company had her file for NYS short term disability, had the checks sent to them, which they kept and paid her salary to her. Technically, they said that they paid her whatever the difference between state disability and her salary was, but they put it all in one check to make it easier on her. Once the disability period ran out and she was just on FMLA, she got 80% pay.

Then I would just apply on your own and see what happens. It's just a form that your doctor fills out part of and you submit. If you can't ask HR if you are entitled to it, this is the best way.
Is there anyone you work with who went out recently on STD for another reason? Maybe they know.
