Supreme Court Abortion Case- what do you think?

What do you think about the case before the Supreme Court requiring minors to obtain parental consent 48 hours in advance before getting an abortion.

This is not a debate about the merits of abortion, but the requirement of parental consent.

PLEASE PLEASE PLEASE keep this civil. Its a debate about a policy- not a personal attack on anyone. Everyone is entitled to their opinions.

IMO yes i think if it is a minor they should have to notify a parent and get consent.

I've been reading thinking about this today. I do think that minors should seek parental consent. As a minor getting a medical procedure, I believe it is the parents right to know what is going on with their children's body.
However, I believe that doctors should be able make a decision if the minor's life is in danger (which is one of the main topics of debate today). They shouldn't have to "wait" for a permission slip from either a parent or judge in order to save a minors life.

I am against this law. In college I heard a woman speak against parental consent laws. Her daughter died getting a back alley abortion because she was afraid to tell her parents and the state required parental consent.

I don't think this laws prevents minors from (a) getting pregnant or (b) having abortions. It just makes them more difficult- and encourages girls to hurt themselves to try to get rid of the baby or the get rid of the babies once they are born in a very ghastly way.

JMO.

ETA: There are some girls who can't tell their parents for fear of being forced to have the baby, beaten or thrown out.

I agree with this in theory, but I think my position might change drastically if or when I have a daughter. Honestly, I am very torn on this topic.

I am against the law as I don't believe that parental consent should be necessary. I am sorry if a parent is held responsible for pretty much EVERYTHING a child/minor does.
then they have the right to know about their childs health status!

Shelly, as an attorney, maybe you can answer this, but who has standing to come before the court? Is it the minor? The reason I ask is, as a teacher, we were not allowed to even dispense asprin without parental consent. So my question is that if parental consent is required for all other medical procedures, how is this one different legally, that it can be challenged?

I would rather my daughter have a safe abortion without me knowing than an unsafe one.

I had a conversation with my gyno a few years ago about birth control. do you know how many parents do not let their children go on birth control??? She told me that a girls father or mother would come with her to every visit and the mother would come in the room during the exam to make sure that she ddin't get birth control. In a case like that, I think parental consent would not prevent the kid from getting an abortion, but from getting a legal one. I just think it promotes unsafe abortions.

sorry, i see your point. BUT if my child is fearful of coming to me about one what about if they have MULTIPLE ABORTIONS.

And the medical consequences to that?

IMO as a minor who is fearful, this could VERY EASILY happen. And i am not about to be ignorant to my childs welfare. A minor is a MINOR for a reason.

Wow this is a tough one..I guess it depends on what minor means....16 or younger. Yes get a parental consent 18 or over no way I don't think any parental consent should be requiered.

I practice corporate law- its been a LONG time since I worked on constitutional law. There really isn't such a cut and dry answer- otherwise this case would never have reached the Supreme Court.

I believe in NY that minors can obtain birth control wihtout parental consent, but I'm not sure.

When the woman spoke, did she say or admit that she would have beaten or thrown out her daughter for coming to her with the news?
I think the key here is to have open communication with your child so that they won't seek back alley abortions though ...
The child was afraid to tell her parents, yet chose to go to a back alley abortion clinic ... do you really think she was mature enough to make her own medical decisions then?
I just think that if teens are adult enough to have consentual sex, then teens need to be adult enough to speak about it with their providers.

Teens shouldn't be using birth control anyway, they should be using condoms to prevent the spread to diseases.

Her daughter didn't die due to the required parental consent she died due to feeling the need to get a back alley abortion because she feared her parents opinion. I don't fault the law I fault the parents. I think the law opens up lines that the parents and children have to discuss it and the 48 hours gives them a small window of time to get over the shock and possibly change their opinion and keep the baby or put it up for adoption.

I agree- in theory. My goal is to never get in that situation with my daughter- that she is free to talk to me about ANYTHING. But I know from my own experience, that there were things I didn't want to tell my mom- granted I never got into any trouble. But I certainly didn't tell her how far I went with a guy, or if I got drunk or when I smoked pot for the first time. Kids are immature- true- and they can feel ashamed, embarassed or scared.

But if it comes down to it- I would never want my kid to feel like she doesn't have that option.

And what about the girls in families that would beat them or disown them or force them to have the child? What happens then?

ETA: Do you think parental consent should be required for birth control?

Lisa I totally thought the same thing !!! I mean there was obviously an issue with the communication between them. I think instead of speaking against the law she should be speaking about the communication between parents and children.

I see the point of the safety issue but you can't make laws against bad parenting, and that's ultimately what doing away with parental consent is attempting to do. There will always be bad parents who endanger their child's welfare, be it in a situation like teenage pregnancy or anything else. But I can't see structuring the law (are lack thereof) on this one issue as any more important/relevant to the welfare of a child than any other health issue.

It's a tough situation and I definitely see the grey area but I have to say I agree with the law. You can't even get a tatoo or your ears pierced without parental consent. I don't think that you should be able to make such an enormous decision about your life and the future life of another without the same thing.

Excellent point but there are LOTS of teens that don't know how to use condoms. When I worked with teens, more then 1/2 didn't know how to properly use one. I think this goes back to better education regarding sex.
