After 5 1/2 yrs my company (my boss) is scr*wing me over...

Im not shocked, he is a bit of a back stabber and we butted heads a little just before I went out on maternity because he was really demanding and not understanding I was 8+ mos pregnant and feeling really bad and my commute was 3 hrs a day to NYC...

Anyway ....when I go back to work I no longer have my spot working for him. Chat Icon I'm basically going to cover where needed until something opens up and if I'm interested I can take it. Gee thanks.

Five and a half years I worked for this guy. He came to my wedding...he hugged me when I left to have my baby and told me my job would be there when I came back. He called to congratulate me when I had her...now he scr*ws me over.

I'm sorry I just feel so disappointed. I just wanted to vent to you guys Chat Icon

I could be wrong, but if you are out on FMLA, doesn't he have to hold your position until you come back? Isn't it illegal for him to do this?

I believe this is true as well they have to giveyou your job back I would look into it more and find out

If the company is less then 50 people he does not ahve to follow the FMLA rules.

That is correct, less than 50 employess, the employer can do whatever they want. Sometimes I wish men were able to have babies and see what we have to go through.Chat Icon

Tsk tsk tsk... even if FMLA isn't applicable, it's just bad company etiquette. But you should look into it - if FMLA DOES apply, what he is doing is illegal under the FMLA law...

Yeah they have to give me a job similar to mine and at my salary - which they have. They talked to me yesterday for a while and they were telling me I'm such a valuable employee and they dont want to lose me blah blah blah...its just his decision, not the company. My firm is big - my firm alone has 100+ attorneys so I'm not without a job, I just feel stupid about what he did to me...you know?

I dont know what the standard is but I believe you need to apply for FMLA. You can't just assume you have it. My company and my friends company are required to apply 2 months before the leave. I do hope everything works out for you

I'm out on FMLA as of the last wk in June...they are giving me that, but I go back to work July 3rd. So they are doing what they need to according to the law. It is a nice company, most of the time, just my guy in particular is a bit of a back stabber.

I understand your frustrations. My boss totally screwed me, and I've known him for 9 years. Worked for him in NYC and then in Atlanta. Came to my wedding 2 years ago in NYC, his wife gave me a present for my baby shower, etc. He laid me off at 8 months pregnant.....so at least you have a job. And the way I'm looking at it is, hopefully something better, more suitable will come along!

I feel your pain. I've been with my company for 6 years - I'm a consultant for a large financial house in NYC - My deal when I left for maternity leave (for 6 weeks so that they wouldn't have to hire a temp - wound up being out for 8 becuz of a c-section) that I would only come into the office 3 days a week.

I've been back since January and in that time -my review date got pushed back by 8 weeks - my bonus was a 1/4 of what it normally is, and I've been given MORE responsibility so that I earn my extra 1% raise for next year. I've also been told that I may have to take on another account.

Like you, I feel like, I went out on maternity leave and I'm getting royally screwed!! Chat Icon

I know a few people at law firms if you want to FM me your resume. Also there is a good recruiter I've used Claire from Corporate Search.
