Are they allowed to do this legally?? Like hell would I go in, I would just say sorry you have plans that you cant break, if you need to put extra hours in you will do it another time. Call in the morning to make sure that they know you are not going in and not to expect you.

Ok here's the update:

So, background, I left my awesome job in NYC to work closer to home so that I could go to school at night for teaching. That was in Dec. Since day 1, I knew it was a mistake. She is the boss from Hell, I swear. I prob have called in about 6 times since Dec - very not like me, normally, but in this case, necessary to go on interviews etc.

So, last week I called in sick to go to an observation. My office mate called me to say she was asking her for my comp password. My friend didnt have it and asked her if she could help her? My boss made up something and backed off. The next day, I came in and she called me in her office (she is a total control freak, paranoia queen, etc). She told me she was concerned about my poor performance and attendance, etc. There is this project (HANDwritten vacation accruals, yes, in 2006) that people have been trying to fix for 2 yrs. The girl before me got fired over it. She told me that is what she hired me for (had I known this, having 5 yrs HR exp, I would have never taken it). She said if I made significant progress, I could take off on 7/26.

Ok, so I worked hard, made a lot of progress. Yesterday she calls me in and says "Um, yeah, I'm going to need you to come in tomorrow". I was like, but I made a lot of progress, etc. She said, yes but not enough. We need to work hard to get it done (its all about control here). She said, now why is it that you need off again? I said it is my birthday and we have plans. She said (I SWEAR to God here) "Well, I think these accruals are more important than that. We really need to get this done".

At this point, I did not want to let her see my cry, so I kind of was just like, Well if thats the way you feel, even though I have plans...and she was like, yes it needs to get done. SO I go outside and call my DH to vent. He was really ****** bc she is messing with my personal life here...she dangled that day in my face and then took it back!! He said he was going to call. I didnt want him to, but the train had already left....

So I said, fine, call after 5. (When I leave to go to school). He calls her and calls me back and said "It didn't go good. You better call". I was SO mad and said I knew he shouldnt have called. I normally would never have my family do anything but he was going to say, we got tickets to a show and I paid $$ for them etc".

SO then, I call her and she yelled at me about how inappropriate it was to have him call, it is between her and I, and I said YES but he made plans and spent $$ assuming, most people it would be ok to take this day off....esp since you said if I made progress I could. And I did. It went on and on and I asked her what my options were and she actually asked me if the tix were refundable - I said I have no idea. Then she said I could either take the day unapproved and unpaid or I could take a vac day and work OT (that I do not get paid for) to finish this damn evil project.
SO I told her I will take it unpaid, thank you.

I am supposed to have my perf evaluation on Thurs when I get back, so let's see what comes out of it..

I have never been treated like this before!!!!!!!!!!!!!!

OMG, Jen, that's freaking horrible. I mean, absolutely, downright nasty of your boss! How badly do you need that job? I'd totally quit if it were me. I know it's not a realistic option, but man, it'd be that or I'd kill her!

That stinks. Sometimes, I think woman bosses are worse to work for... By the way, working OT without getting paid OT is probably illegal (FLSA violation).

Your boss sounds totally evil. I am so sorry you have to put up with such horrible treatment. What a witch!!! I have my fingers crossed for you that you find a Wonderful new job very soon!!!

I think you need to get fired from this crap job and collect unemployment, work off of the books & go to school.

At this point, you have nothing to lose (but your job ) by going over her head.

how many people work for this company? if it's under 30 they can pretty much do what they want, if it's over 30, call the department of labor and tell them about the unpaid prior approved vacation day, the UNPAID overtime, etc....
