HELP! Home Contract Issue- Update on the bottom!- we're in contract...home is in whitestone, NY
Hey!
Ok lemme do my best to make a long story short, DH and I found a cute home we love, made a bid and it was accepted, did a home inspection...were satisfied.
fast fwd now to Friday... after our lawyer went back and forth with the home owners lawyer, finally got contract adjusted to how we felt it should be (change was basically the $ to be put down at signing) DH speaks to the homeowner on friday morning, who tell him that she wanted this contract signed and in her hands that day...news to us, bc we didnt hear that, he told her he was at work,and if doesnt get done today (in case our lawyer cant have us come in on that day) he said it should be done by early next week. so ok fine... we make arrangements sign the contract friday afternoon and sign over a check as we agreed. dh calls the owner after we leave the lawyers to tell her we signed, she then says well oh well after our discussion this am, i felt like u were no longer interested, so i'm looking at other possibilities! WHAT? now our lawyer was out of the office yesterday and today he contacts her lawyer and she still hasnt signed!
***? can she do this? what can i expecT?

I am not an expert but I believe if she has not signed the contract she can look at other bids. Hopefully it will work out for you guys!

She can do this because you did not have a fully executed contract(signed by both parties) The key is to get everything moving as quickly as possible. Did you have a buyers agent because they may be able to call the sellers agent and work something out and your lawyer should be way on top of it. She may still sign but if you guys have her # you should just call her and tell her you are very interested and it was a miscommunication. She is well within her legal rights though.

we've been communicating with her....and she knows how bad we want the place, but I dont understand her, shes not in a hurry to move, but in a hurry to be in contract.... why look elsewhere if we already signed? so frustrating...
DH just called and said that our lawyer called him and said she is expected to sign the contract tomorrow and currently is in the hospital with her daughter who is giving birth.....I hope she signs tomorrow...maybe becoming a grandma for the 3rd time puts her in better spirits!

Congratulations! We're in Whitestone too. And we were from Astoria also. We just bought our house a little over a month ago.

aww thats great!! I'll be happy to be ur neighbor.... I dont have a closing date yet but hopefully by labor day its a done deal.

FH & I both live in Whitestone and we love it...we're trying our hardest to stay around here...keeping our fingers crossed that prices will drop a little when we're 100% ready....
