Im so confused...

When I canceled my wedding... I posted on LIW in the BHB section..letting everyone know that date was avaiable...

East wind has like 5 grand of mine...which I dont get back unless the rebook (even though I gave them a years noticeChat Icon )

Well the other day I check LIW (because its a rarety now that I am no longer wedding planning) and I have FM from someone I had never chatted with nor even seen while I was on the boards...but has like over 1000 posts so I assume is the real deal..

Anyways she write going on and on how the law says the have to give my money back blah blah blah... (meanwhile my original post said NOTHING about me getting my $$$ back) I w/b saying my contract states I only get it back if they rebook...

She sends me some link about the law... which the way I interpreted it meant the same thing...

She then send me a FM saying SHES NOT GETTING INTO A LEGAL RELATIONSHIP WITH ME...???

***... I didnt even contact this person...what the heck is she talking about??

Do I need to be in a legal relationship with someone... are they supposed to be giving me my money back...??

I was well aware of the deal when I signed that contract...???

I have no idea what this chickie is talking about, but I have heard a lot of talk lately on BHB about certain rules in Suffolk where you have to get all your money back if you break the contract with a certain amount of time left, so you should def look into that.

well she send me some suffolk law thing and the last line says:

"B.With regard to cancellation fees:




(1)If a consumer cancels a catering contract and the caterer is able to rebook the date, the caterer's cancellation fee may not exceed 5% of the total contract price or $100, whichever is less, plus actual expenses reasonably incurred."

Which would mean... I dont get my money back unless they rebook right?

That's what it sounds like according to that portion, but I would still look into it or do a search on LIW. Like I said, I've seen different stuff about getting full amounts of $$$ back.

What the heck??? tell her u r not asking for her advice. I would think without knowing the fm to u that she is a lawyer or student of law that is trying to give u advice but when u fmd her back maybe she felt that u were needy of her advice and she only wanted to fm u once. I would forget about it. dont even bother with the fming.

Talk to a lawyer on the phone. they should be able to give u more info on what the law is. when was your wedding cancelled? how much time did u give them?

I agree not to bother FM'ing her. Too strange.

I would bother to check if the hall rebooked the date on their own. Call up & see if it's available.

That is the law in Suffolk. My catering hall gave it to me when I got married in 2000.

No one is passing law school without some command of grammar.

I am confused. this has nothing to do with the question but, arent u married? did u change places or something? Also a year is a significant amount of time. the wedding industry sux but its could that u cant post BS about these vendors for future brides.

Maris - I just bumped two threads on BHB for you - don't know if they will help - but read through them - they mention the Suffolk county law. You could also do a search and put in the word cancel. I put in refund and then I put in rebook. A bunch of things came up.

Yes Im already married....

The quick version... City hall...so my dad could be there (he's in Iraq now) and so we'd be married when my son was born...

Our "fancy" wedding will be done this summer...in either Vegas or the Carribean...just me him and possibly our son....

Very nice. I cant believe east winds cant accomodate you. I had a suggestion though in terms of making everyone slightly happy. Can you talk to east winds and compromise saying that u gave them this 5000 dollars and since you cant find someone to replace the date could you use it toward a weekend stay in the hotel as your credit. They have a spa and beautiful rooms. Do it as a small honeymoon weekend. If they wont do this tell them you paid for half the day so you and your family will be there. (sarcasticly speaking)

Well they still have 10 months to rebook the date...so Im not about to play lets make a deal ...YET..

However Mrswask...those thread you bumped..make it seem Im entitled to my $$$.... I contacted Nicole...since it was her friend!

I think I might know who the original poster is. At least the one who posted the exact law on the boards. I was friendly with her and we FMed several times back and forth while I was planning. She was an 05 bride but is now an 06 bride. Yes, she is a lawyer and last I knew practiced in NYC.

She is right. There is a Suffolk Co. law that states if you cancel with a hall more than 6 months before your booked event they must refund you all of your money minus $100. If you can get $4,900 back why not?
All you have to do is go to your catering hall with the law in your hand. If you cancelled with them 6 months before your date and have proof of that cancellation in writing (most only accept written cancellation) then they are legally obligated to give you your deposit back minus $100.

I think I know who you are talking about too. She's really nice, and I don't think she meant any harm or wanted to freak you out. Over time she saw a couple of brides whose halls tried to pull the whole "rebooking" thing on them. So she researched and found that law for them, hoping that they would be refunded their deposits.

i'm sure she added that bit about "not entering into a legal relationship" with you as sort of a disclaimer that she's giving you a tip as a bride, not that she is your lawyer. know what i mean?

I would try and get that deposit back- it is against the law for them to keep it AND thats quite a chunk of $. Good luck!

The woman who posted the law on that thread...isnt the person who FMED mail... but that dosent matter anyway....

I wrote East Wind a letter, attached with a copy of the law, and DH is sending it certified today!

I also called... Was soooo nice...and just basically told them the info I came across...and the guy said they only have to give me my money if they rebook... and they havent rebooked yet... hmmm????

Yes...and when I said that to east wind they said that its presumed..that they'll be able to rebook it..but they havent so there not giving me my refund yet...

Am I misunderstanding what presumed means???

what is the date that it is the HARDEST date for them to find a future bride. I mean they are getting bad publicity by you being able to make others aware. Strange enough, this is the same place that gives away free weddings at their showcase. Let them give your date away, give u back 5,000...then everyones happy.

Make SURE they have not booked your date yet and are just telling you they haven't. I would have someone call and say they are interested in that date adn see what they say. I am always so skeptical of these places.
