Feeling a little iffy....

so most of you are probably aware my situation with the annoying/greedy sellers...

well, yesterday when my RE agent told me that they upped $14k more than they countered ($29k more than we originally offered), I said absolutely not....
.. and I told my agent that this house needs updating, they should not be asking for the price they are and the $ we agreed I felt was reasonable, because we will end up having to refinish the floors, fix the bathroom leaks and update the kitchen....

... well, so she communicated this with the sellers agent and the sellers agent told the sellers that we will buy the house AS IS...

now.. I NEVER said we will buy AS IS, just that we would be willing to do some updating... I feel really iffy on them saying AS IS because what if there are other things I need to fix up that I didn't see when I was at the house???
OR what if they've broken some windows or doors AFTER we saw the house???

wouldn't this bother you?? Any advice on what I should do??

no, house is not inspected, but the AS IS does not include damages that'll be on the inspection report....

is more for like, scuffed up hardwood floors, leaky bathroom, old and yucky kitchen cabinet and sink... stuff like that...

Before doing anything else, I would get the house inspected. This will give you a better idea of what you are looking at in terms of repairs and how much you want to pay for the house. Remember, you are in the driver's seat. They can't force you to pay more than what you want for it.

In regards to broken windows, doors, etc. This is why you do a walk-through before closing so any things that may have changed (after you viewing the house and inspection) can be addressed.

I wouldn't waste the money on an inspection until you have somewhat of an accepted offer.

Get a signed binder from the RE.

You want to be able to talk them DOWN after getting an inspection if the house needs work. If you get it inspected before you make a final accepted offer you lose this leverage.

I am not sending an inspector there till I have the acceptence in writing. However, when I spoke to my agent yesterday, she said the buyers agent told the buyers that we will take the house AS IS for the price we previously agreed on.
I am just a little uncomfortable with the term AS IS, but my agent explained it to me as we can't negotiate to get the price down for little things as the floor is scuffed up or the faucet is leaky, etc....
I don't know how comfortable I am with it yet...
... I guess I'll worry about it when I have a definetely answer from these people.

Tell them you will take the house as-is. Almost every house is sold as-is. Most people don't realize this... but an as-is condition is in just about every sales contract.

Get a written acceptance from them... then send an inspector in.

If the inspector says the house is good... its ok to accept it as-is.

Just make sure you get a GOOD inspector.

Just remember that as is also includes all the appliances as well. You can NOT go back and renegotiate if it is as is so if you have any problems (ie, CO's) it will be up to you to resolve this problem.

Good luck. I can see how badly you want this house and I'm sorry that these people are giving you a hard time.

If the only issue I have when I buy my house is a leaky faucet.... I will consider myself LUCKY and happy. Chat Icon

Leaky faucet... how much does that realistically cost to fix? Not much usually.

OK....IMO you saw the house....You make offers...They counter...
If you feel that the house needs updating that is great....
1. that doesn't mean that the owners are going to change their price offers for it and nor does it mean that they are going to do the updating...

IMO this is the bidding process and no i wouldn't be annoyed by it...Don't even think that they are being "greedy"....
They are trying to get the most they can...can't blame them for that

we were planning to fix those things ourselves, but if they want MORE money and still want to sell the house AS IS - that is not going to happen with us, as the house needs serious update...
perhaps they can find someone else who is willing to do that

with all do respect, you have not seen the house so you have your opinion and we have ours.
The word GREEDY was used by THEIR RE agent, he knows what condition the house is in and how much these people can get for it, but they want more...and we already agreed on their counter, which was $15k more than we offered and now they came back wanting $14k more.
I understand people want to get the most they can when they sell a house, but they also have to be realistic.

We are moving on this thursday if we don't hear from them because we don't need this added stress...

would you want to pay 465k for a house that needs serious update??

ETA: We were only at the house about 25 mins, but what from we saw, the bathroom was leaking, don't know exactly what was leaking but there was a bucket there to catch the water... the sink has a large crack.
wood floors are seriously scuffed up, some pieces needs to be replaced because there are gaps...
kitchen cabinets are dingy, the couter top are burnt and has to be changed, the sink and faucet also needs to be raplaced.

some carpets in the bedroom needs to be ripped off as they are really stained...

the reason why we put in the offer for this house is because we like the school district and the neighborhood, and saw potential in the house when we finish the updates.

Hopefully you will find a compromise....

thanks for your suggestion, I hope you don't have to go through stress like for your house hunting.
We have our reasons for wanting the house, but with all that's going on, we are going to move on from it as of thursday.

the other houses in the area with the same SD and same type of house is going for $470k, but they are all newly renovated. My RE agent did a search on all sold houses in the area.

Ditto... to a point. Chat Icon If I was really greedy... I would have listed my co-op at 309k like some other knucklehead did.

Then NO WAY would I pay $465k for something that needed a lot of renovations.

I didn't intitally know what your reasons were for giving a low offer. I thought that by updating you meant having to gut out the entire house and put all new walls and everything in every room from scratch. What you listed to me just seems like pretty basic, low costing stuff. Any house that I would have bought I would have automatically ripped out the carpets (I get grossed out just thinking of what is on them), and re-do the floors. I wish that was all my house needed when I bought it, but like you said, you saw the house, not me. I wish you all the best. Only you know what is best for you and your mate. Good luck.Chat Icon
