thanks for your suggestion, I hope you don't have to go through stress like for your house hunting.
We have our reasons for wanting the house, but with all that's going on, we are going to move on from it as of thursday.

I don't understand why you are taking this so personally?? We weren't saying they are greedy for asking $29k more, but rather they are not being realistic. Our offer is the only one they've got for the month they've listed, if this house is really so reasonably priced, shouldn't they have more offers??

... it's great to come to this board seeking advice then get attacked for it.

Yeah, seriously. it's only a few thousand dollars difference? wasn't the house you put a bid on 465k? and the newly renovated ones 470k. That's only 5 grand!

I have somewhat first hand experience on what hell an estate sale can bring.

My wife's grandmother's house is being sold as an estate between my MIL, my MIL's sister that my wife CANT STAND, and I believe another sister.

So... I am sure other houses will sell in that range too. When were these houses sold? 3 months ago? Or a year ago?

If they were sold recently... and you are implying that houses on the market are being sold for more... thats BS.

They will come down in price cause if they sell that high... they will have appraisal issues thanks to the lack of comps.

My house was an estate as well, which is why I can totally relate as well.





Yeah... I only heard bits and pieces of the story being on the "other side". But what I did hear... oh man what a mess. They had to work out over a year of back taxes. Had will issues (one of the sisters stole the will). Total disaster. Chat Icon

I think the house is finally sold now. They originally were working on selling the house when my wife moved in with me (back in Jan of 04) Chat Icon

Actually now that I think about it... my wife was the last person to live in that house... and she moved out in November of '02 because she lived on her own for a year... and then moved in with me in December 03, January 04.

So that estate sale theoretically took over two years to complete.

Oh dear! what drama! My house was being sold as an estate but she was getting a divorce from her husband who felt that he should get half although the house was never his other than his living there for whatever number of years that he lived there. The woman truly loved the house but their kids (his and hers) had all moved out and had their own families and homes so it would be silly for her to keep such a big house for herself. So we basically sat in the sidelines and watched this all play out. Chat Icon Then we had one of the daughters decide that her mother was becoming too ill to deal with everything so everything had to go through her. The mother also gave her power of attorney and then tried to get us to back out of the contract so she could keep the house for her mother. It was just too much drama. Their attorney advised them that the house was legally ours and that they had to go through with the closing being that we had a legal contract binding us to the house. It was like watching a soap opera. Luckily, we were able to go to closing a few months later and everything worked out. But it was just terrible.

everybody is taking this post so personally, which was not my intention to offend anyone whether they are selling a house, or in an estate situation, however, I do not feel that I should be attacked just because people take things too personally without even understanding the situation..

from the last few posts, you can just tell that my replies were not even read thoroughly before you post yours (ie, RE agent did a search on SOLD houses in the area to compare prices).
The houses that were sold around the area are within 3 months, however, ALL of the sold listing we found, either they have a bigger lot or the house just been recently renovated in diamond condition.

The whole point of MY situation is not that the house is an estate, because I am sure this isn't the first house in the history of houses that's an estate, and the point is not that they are being greedy for asking what they are asking...

THE POINT IS, they don't even care about what the market price is for their house they jsut want to get what they want to get for it, because 4 out of the 5 brothers don't even live in this state and they don't know about the market, they just saw $$... this is exactly what their RE agent relay to my agent.. not solely my opinion....

and if they wanted $465k, they should just said $465k to begin with, not counter our offer to $450 then 3 days later come back wanting more.

I appreciate most of the advices I get on this board, but I will not sit here and take the abuse from people who are not even trying to understand the full situation before they jump at me.
Obviously not everybody is going to agree or get along, but I firmly believe the saying "If you don't got anything nice to say, don't say anything at all"

we are in that situation.. my FH and I were going to buy my parents house, the house I grew up and LOVE, but my father is being very difficult and nasty and would not sell us the house, he rather sell it to strangers so he can get the full price (which we can't afford right now)....
I've cried about it, I hate to lose MY HOME but there is nothing we can do, so we had to move on and find a new house....

You have to understand unfortunately that... its the sellers RIGHT to ask any price they want for THEIR house. You say they shouldn't be doing that? I say why not? They have every right to do so.

And its YOUR right to simply tell them no thanks and move on.


And believe I am not taking anything personally. I am just trying to visualize why you are justifying this as "THE HOUSE" for you to buy when all you do is say how bad condition it is... and other houses are selling for slightly more. Doesn't make sense.

You laid out the situation and asked for advice...you have to expect that not everyone is going to come back saying what you want to hear.

Based on everything you said - I, personally, would have walked when they came back 3 days after already accepting a counter they offered - wanting more money.

If houses sold 3 months ago, in diamond condition, for only $5k more than what these people want from you...they are out of their mind.

Rich, I am not understanding you, I never said this house is in a BAD condition, but it needs to be updated before we move in...
and the houses that I mentioned that's slightly more are SOLD SOLD SOLD, if they are not sold, I wouldn't be in this situation, I would just buy one of those houses....

I see potential of this house and willing to pay $450k for it, are you saying I am not entitled to my feelings and how I want to spend my money? But for them coming back asking more than they asked 3 days ago is just unsettling.
I was going to drop this house the moment my agent told me they came back wanting more money, but my RE agent suggested to give them a few days and I agree.

If you don't mind, I would like to drop this whole thing, perhaps I should of never BOTHER anybody with this.

Yes, the sellers have the right to ask any price they want, (within reason of course, with the market).....but if the seller was presented with an offer, and that original offer was accepted, I don't think its right that they say forget it, and then Up their number.

For example, I have a listing in Southampton for $1 million dollars. My seller gets an offer for $950K, and accepts. A week later, the seller turns around and says, I've changed my mind, I want $975K - THAT is not right. And any buyer would have every right to then back out and walk away.

That's like you PiLL...you're asking how much for your co-op? Would it be right if 2 weeks from now, you changed your asking price for $30K more???? (unless you put in major renovations that would justify such a increase in asking price) While it may be within your "rights" as a homeowner, and you may get some fool to buy it anyway, it still isn't the "right" thing to do. JMO.

True... but in OP's case. The offer was never accepted. One brother still says no. And she has no binder from the RE office. No binder = they can keep negotiating up all they want.

so we finally heard back from the seller, they are countering 15k more of our offer.... we are going to go for it!!

4 of the 5 brothers are good with their counter amount and one brother wants to wait to get an offer for the listing price.... so it might still take some time for them to sort things out...

You should have never agreed to any counter offer unless it was clear that ALL the brothers were OK with the counter. One guy is holding out... and they are using that as an excuse to drive the price up.

If you knew that 4 of the 5 brothers were "good" with the original counter of 15k that you were willing to take... I wouldn't have said yes to this until you got written proof that all FIVE were Ok with it because it will take FIVE signatures that are required to execute a contract... not four.

Doing this... you unfortunately lost your bargaining position. Its not your fault.... but its what happened.

I would move on because you are going to overpay for this house.
