adding a name to the deed

what is the process for this? i want to eventually put my husband's name on the house. depending on the process will dictate how soon. Chat Icon

You can't just add a name to your deed. You will need to file new legal docs. But if you have a mortgage, you will also have to check with your lender to see if they have certain stipulations (most do). I'd contact a RE attorney and your lender to start.

Homeowners add additional owners to their deed all the time; it's fairly common. You do need to consult an attorney to have them prepare the new deed (and any related docs) and record it.

I don't think their should be any issue with the mortgage and no need to refinance (as you are not trying to add anyone to the mortgage loan, just the deed, correct?).

If you need a good real estate attorney, Kristen Breglio (vendor on this site) is the BEST!

ETA - l would NOT contact anyone (including your lender) until you consult with a real estate attorney first.

I think anyone on the deed should also be on the mortgage, no? Otherwise aren't they part owner of the house without any financial liability?

if possible you should try to get them on the mortgage as well. to get the rights, they should get the responsibility.
i had an ex on the title and not the mortgage. what a B**** to fix. Then again we werent married so I'm sure its different.

My name is on the deed to our home, but the mortgage is held only by my husband. We did this when we closed. In fact, when we went to closing, the deed was originally just done in his name and it was changed at the closing table to include both of our names. No problems and no one had a problem with it.

We had a lawyer do it a few years back. It was easy -we just had to pay him:)

it's much easier to put someone on - then to take someone off

I would speak to a lawyer and make sure it's the best move since you bought this house prior to being married - make sure you are protected

the mortgage will still only be in your name- so you will have all the liability and he will have half ownership (and half of the equity)

My mortgage is just me, but me and DH are on the deed. His student loan situation made it impossible for us to qualify for a mortgage with him on the mortgage. The bank was fine with this.

I don't know I really don't see the need or urgency for doing this, especially if you have to get lawyers involved and pay them. It's one thing if you just have to pay a town doc fee, but to pay lawyers good knows how much seems like a waste of money IMO. Chat Icon
