Anyone have a tree that was not yours fall onto your property???
I don't know what to do. Our neighbors who are right behind us have a tree right on the edge of their fence. Two weeks ago in those storms a huge limb from the tree snapped off into our backyard. The limb is wedged in the tree and other parts of it are quite large.
I just called my town and they said they don't deal with trees in backyards. So now what do I do....go to the neighbors and tell them they need to handle it? I refuse to pay for removal of a tree that is not ours.
Also, the town said if we want to put it out as yard waste we have to cut it down into little pieces and bundle those together! That will take DH hours to do.
I don't want to start a fight with our neighbors but I am at a lost for what to do.
Any one got any ideas?? Thanks

Sorry I can't be much help, we had the same thing happen during a storm in December. Their tree split, fell into our yard and it broke the swingset.
We were told by the insurance co. that the neighbor is not liable as it is an act of god. For insurance purposes, if you can't prove that the owners knew this would happen (i.e. the tree was diseased), they are not liable for it.
We had to cut it into pieces and tie it up. It was a huge PITA, since it was half of the tree. We didn't know the neighbor behind us so we didn't pursue it with them.
If you know them, I would let the neighbor know what happened and see how they respond, they might not even be aware that it happened.

We had a tree fall last month. The people next door believed it belonged to us, and came over to tell us about it, and to have it removed. It turned out that out of a lot of trees that separate our property from eachother, that the tree that feel was actually 1 of 3 of those trees that actually belonged to them. Just talk to your neighbor, tell them that you weren't sure if they knew, but that a tree from their property fell into your yard. If it was on their property, they should be taking care of it.

Do you have a good relationship with your neighbors? If you do, I would talk to them about it. If you want, you could offer to help them remove it, but that's up to you. I do believe they are not liable for anything that falls on your property however.
FYI--I think they should have come over and spoken to you about it. We did this when a tree fell down in front of our house (it was a town tree, so we were not responsible for removing it, the town was). Although it wasn't our problem, we wanted the neighbors to know we had notified the town to remove it. It didn't damage any of their property, but it was lying right in front of their house and made it tricky for them to leave their driveway. So, I think your neighbors should have spoken to you, but that's JMO.

I would speak to them and see how they want to handle it.
If they don't want to pay or take care of it, I would take care of it by dumping all the pieces I had cut back into their yard.
