ATTN any HR people - kinda long
My stepfather was laid off at the end of February was told they were going to keep him under their medical insurance until the end of March. So my mom went to the doctor on 3/12. Today she got a bill for like $700 from her doctor stating that her insurance company denied the claim. She called the insurance company and they stated that his employer cancelled his policy as of Feb. 1. He never received any notification or the option to purchase Cobra. Is there anything they can do, or any action they can take? Is there any sort of law about this?

he shoudl have rec'd Cobra enrollment forms and been notified of the cutoff date. But how did they cut him off Feb 1 if he got laid off the end of Feb? He should def. be covered that month.

I know, they told him the whole time he was covered, but in reality they had cancelled it and never gave their employees the forms for Cobra. Needless to say this company is kinda shady.

No, but they never did because they paid for the entire premium.

No, but they never did because they paid for the entire premium. ahh. I ask b/c I had the same problem when I left my last job & the COBRA issue was clarified on paper once I showed proof of the insurance payment.
Sorry you even have to deal with this, but I know they are required to offer you COBRA.

I just recently had this issue occur with one of my employee's. It was a clerical error on the part of the Insurance company and took approx. 30 minutes to clear up.
He should have had coverage, at least through the day he worked. The end of March sounds funny to me b/c most plans are set up so that the coverage is either in tact through the last date of employment, OR through the end of the month in which the employment relationship is separated.
Also, he should have received COBRA paperwork already. He really needs to reach out to the Company HR Rep...
