Cell phone while driving
I got pulled over today...the cop accused me of talking on a cell phone while driving, saying he saw something black by my hand. Yeah, there was something black by my hand...my HAIR! He asked me to check the calls on my cell, mind you my phone was ringing as he was standing there. When I told him the phone was just ringing and he was standing right there when it did, he said I must have been using my phone to talk to nobody (yes, seriously, he said that).
My question is, if this points on your license? My DH thinks it is. I plan on fighting it in court, but would like to know. Thank you!

It doesn't seem like you will get any points but will be required to pay a maximum fine of $100 and mandatory surcharges of $50.
I would fight it. You can get a copy of your phone records from your cell provider to prove you weren't on the phone.

fight it, all you need is a copy of your phone bill to show that you were not actually on a call at the time..
In Nassau it is a moving voliation which is points. I dont know about suffolk

I would fight it with your cell bill because he needs to prove you were on the phone which you said you weren't. That will definitely help you and make him look like an idiot.

I am definitely fighting it...no question. I could have sworn there was a thread a while ago about weather this is points on your license. The reason I ask is a friend of mine had to pay a fine and she didn't even have a cell phone (fine was reduced).

It's a State law no variation in different counties
From the NYDMV
New york State Law does not allow you to use a hand-held cell phone or mobile device while you drive. You may use a hand-held cell phone or mobile device only when you call 911 or contact medical, fire or police help in an emergency. You can be ticketed for using a hand-held cell phone or mobile device while driving, and will be required to pay a maximum fine of $100 and mandatory surcharges of $50.
If you receive a ticket for this violation, it is not considered a probationary license violation and the DMV does not assign any violation points to the driver's record.
You totally rock! Thank you! Funny though the fine on the ticket is $155

I would get a printout of your calls, and then fight it. I was driving to to work the other day and saw a police officer in his police car talking on the phone! I was so mad!!!

You see, that makes me angrier than when I see the average Joe do it.
I am definitely pleading Not Guilty and fighting it. Plus the guy was such a complete jerk about it too. Hey maybe he was having a bad day, or maybe he just doesn't like women in blue cars, I don't know...but don't take it out on me. I had one of the worst weeks ever and I am not taking it out on others.

A friend of mine is a cop and he says that emergency personell are allowed to use their cell phones while driving. I think that's silly, I can understand if they are on an emergency call, but I have seen many cops on their phones driving normally, I doubt that that was an emergency call.
IMO, we all should be held to the same standard.

I once hid my cell phone when a cop caught me - it was under my seat and he let me go because I told him I didn't have a cell phone with me!!!

You should definately fight it. Some insurance companies cancel your policy for talking on a cell phone while driving.

I got a ticket for this as well. It was $90 with no points on my license. I'm on call for my job and I stupidly picked up the phone when I was driving. From now on I told everyone they will have to wait until I pull over.
