Charging tax on a "service"?
I'm not sure what to call it....
Hubs took his lawn mower in for service. It has a warranty, so it didn't cost anything for that but they did charge a $29.99 "diagnostic fee" for them to look at it, ridiculous IMO. BUT on top of that, they charges sales tax! I'm not exactly sure what they were selling is that legal? I wanted to argue it, but we just wanted our lawn mower back (this whole thing has been a hassle!)

everything has sales tax
I just got into a fight with the car dealership b/c they forgot to add in the sales tax on the miles I went over on my lease
who the heck knew that had sales tax-
and the bank sent me a bill
(I got them to pay it)

Not true - think back to wedding planning days . . . DJ provides service NOT goods, no sales tax, same thing with limo.
To the OP, not sure about repair service.

CERTAIN services are taxable, others are not. Depends on state law. I'm pretty sure auto repairs are taxable.

As of June 1st - a whole slew of new tax laws went into effect - including sales tax on limo service... That's a "service" so maybe repairs are taxable too?

What about lawn mowers on long island... not the actual service to it. That was under warranty and free.
They charged $29.99 "diagnostic fee" to look at it and decided what was wrong w/it. I don't agree with that BUT they charged tax on it - at the register it was a "service fee" with tax.

Yes it's considered maintenance. They are diagnosing the problem. That is part of the maintenance process.

At my DH's company the only thing that is not taxed is Website Design.
Everything else is taxed, including if someone brings in a computer to be fixed, service contracts etc.
