Curious about this.

Say I decide at my son's cpse meeting that I do not want to take the placement they are offering, that instead I want to send him to a typical preschool - do they have the right to deny him his other service(s)? Like, can they be vindictive and tell me if I don't put him in XYZ program, they will not provide him speech (and/or PT should he qualify)?

Ds therapist said that my district (plainview) has done this to at least one parent she knows and I want to know if that is even legal?

No they cannot
Legally cpse is not mandatory I think and as a parent u can choose what services u want. I think the district if it did that is illegally doing it. At least
This was what I was told. I did send my son to special ed BTW as he has severe disabilities

There are also integrated preschools you can look into - classes with typical and special needs kids together. Maybe go on a tour of all the schools and bring your DS into each class before making a decision.

I never sent my daughter to a developmental preschool, essentially rejecting the proposal of the school district. They did however, grant us many SEIT hours, speech 4x and OT 3x weekly. At age 3, all those hours were at home or at an agency with a sensory gym. When my daughter was 4, we sent her to preschool (montessori) and had a SEIT work with her there and another SEIT work with her at home. I had EI therapists telling me all types of misinformation. It is your choice as a parent what type of educational setting you want your child to have.

Thank you all for your input.

I am touring both typical and special needs schools - mainly looking at inclusion/integrated rooms.

I was curious if the district COULD deny me services should I choose to send my son to a typical school.

As far as I know, Plainview has pretty much cut out any SEIT program they once had, and that they are nearly impossible to get now.

I am a Montessori licensed teacher, and so far what I've seen is making my skin crawl. I really want to send him to my former place of employment, but as suggested, I am looking into as many schools as possible to see if any are a good fit for him. I just want to know my rights and his rights, and if the district could tell me they will deny him Speech if I place him in a typical school in leu of their possible suggestions.

Possibly get in touch with an advocate who specializes in your town's school district as they probably know all the ins and outs of the policies and what happens in these meetings. Here are some contacts to try -

IMO, they can do whatever they want, if they don't think a parent will fight it. I think in most districts, if you turn down the placement, this may give them an argument for denying you SEIT services, since you were offered special ed in a center based program and refused it. I don't see why they would deny speech and PT but I've heard lots of stories that don't make sense and seem to be made more for budgetary reasons.

If you can make a case showing that their placement is not the best setting for him, you may be able to get whatever he needs at the preschool you want him in. I think you might need an advocate to make that happen, though.

And with all due respect, this is a little insensitive, since you could be speaking about a school where one of our kids goes or has gone.
