Debt Collectors Keep Call My House....Looking for Jose Santos
I have no F'ing clue who this guy is, but debt collectors have been calling on and off since we moved in about a year and a half ago. The calls come in waves...
Is there anything I can do to make them stop?

WE have the same problem-debt collecters, companies that this man owes money too call our house at least twice a week for the past 5 yrs-since we moved in!!!!!I always tell them this man doesn't live here and they say they remove our number but the calls keep happening. Oh-our man's name is Michael!

OMG - debt collectors stalk my work phone for some guy. It is the most annoying thing to get 20 messages every day.
I have called the companies to tell them I am not the guy they are looking for - and they keep calling.
If you find a solution let me know bc I'm at my wits end with this!

I had the same thing. I told them the person gave the wrong phone # and to update their system while I am on the phone with them. The calls stopped...

Do you have the name and info? You'll need to send a cease and desist letter through US certified mail to them. Also send return receipt requested so that you can confirmed they have received your letter. If anything happens later, you will be able to prove your actions done this time to stop them from calling you again. This is the only thing that worked for me.
If they violate you can sue them under the FDCPA.
This is what I wrote:
This letter is to request cease and desist of all phone calls and mail contact to my residence at XXXXXX in regards to XXXXXXX. I have no information on XXXXXX Account.
I'm requesting that cease and desist or I will pursue legal action. You are harassing my family for an account that we have nothing to do with. The phone calls and junk mail must stop immediately. Please respect my civil rights as outline in the Fair Debt Collection Practices Act.

We have the same problem...we have been in our home for 2yrs and people STILL clal for Brian...I just say he doesn't live here and please stop calling. For the most part they are nice, but every now and then some a**hole interigates us....I just say stop calling we don't even know any Brians and we have lived here for 2yrs.

I recently had CitiMortgage calling us almost everyday looking for the "Hansons" (not us) and they were calling at 8:15 AM!!! I gave them a piece of my mind yesterday -- demanded to speak to a supervisor. I told them to stop calling and that they should not call anyone at that time of day. Now hopefully the calls will stop, from them anyway.

check your caller ID and write down that #
and then the next time they call, you should say, "oh, he changed his phone # - you can now contact him at xxx-xxxx" and give them back their own phone #

We have the same problem! Apparently the person who used to have this phone # before we got it a year and a half ago is Mr. Ricardo Lopez, who never paid his bills!!!!!!!! The first 6-9 months after we moved here and got this #, I was ready to request a totally new # because we were getting harrassed so much with phone calls for this dude's unpaid bills! SO ANNOYING. Eventually it tapered off and now we rarely get a phone call for him.

We called and wrote to the phone company, google, yellow pages, etc and made sure they changed the info. We also called and wrote lexis to have them change their database. We used to get calls for this hourly. It was horrible.

Same here. We had collectors calling all hours for a person who used to have our number. We threaten them and put a complaint in with our phone company and FCC and then it all stopped. It was annoying for the first months but was glad it was finally taken care of.

I feel your pain. Tasha Burgess has quite a few debts out there and her gyno, family, pharmacy and children's school is always calling me. It's annoying. I now write down the time I get the debt collector calls..after I tell them to not call again, I make a note if they do. Only one has..Fannie Mae...If it happens again, I'll contact Joe Mauro (attorney that specializes in FDCPA) and hopefully make some $$ for the hassle!

Once you tell them he doesn't live there, you've never heard of him, and they have the wrong number, they aren't allowed to call you anymore. Ask to speak to a supervisor IMMEDIATELY the next time they call.

ETA - You also shouldn't have to write to them to get them to stop. I'd keep moving up the supervisor chain until you get that number off the account.

Mr./Ms. Collector,
I am writing in response to your constant phone calls!
According to the Fair Debt Collection Practices Act, [15 USC 1692c] Section 805(c): CEASING COMMUNICATION: You must cease all communication with me after being notified in writing that I no longer wish to communicate with you. Therefore, I demand that you stop calling me at home, at work, on my cell phone or at any other location!
In accordance with the federal FDCPA, now that you have received this "stop calling" letter, you may only contact me to inform me that you:
* are terminating further collection efforts; * invoking specified remedies which are ordinarily invoked by you or your company; or * intend to invoke a specified remedy.
Be advised that I am well well aware of my rights! For instance, I know that any future contact by you or your company violates the FDCPA and that since you already have my location information, calls made by you or your company to any 3rd party concerning me violates section 805(b)2 of the FDCPA.

Sending a letter is the best way to win a lawsuit though. A judge would like to see that you at least tried to have this resolved outside the courts before bringing a lawsuit.
Unless you plan on recording phone calls (which may be illegal in NYS anyways), sending a letter is all the proof you need to win a lawsuit.
And in regards to that sample letter Tine posted, that's fine. However I wouldn't even make it that detailed.
"Do not call. Cease and desist under FDCPA." That's literally all I would put. If they call again, sue and get some free money from them.

I stand by my letter. In my case, it resolved the matter. I have better ways to make a $1,000. I just hope you never fall in front of my house cause I can guess what you would do.

interesting thread.
I just use my caller ID and dont have a answering machine anymore.. i use the message center from Verizon instead now.
my old downstairs neighbors (we live in a two story house) is gone but the debt collectors arent. We've been getting calls for almost 2 years now.. some are just annoying others are down right nasty so we stopped picking up the phone.
Downstairs has NEVER had our number as theirs and they did not have our number from us. Still collectors call US for them *shrug*
