diability after maternity leave question..
We are a small company and my boss(NOT THE NICEST OR EASIEST TO TALK TO MAN IN THE WORLD) gave me 6 weeks leave full pay he then said something like after that you can get disability and did not go into details about it. i was just wondering if anyone knows how I can get disability information and would i still be covered under my insurance. thanks.

Normally you get 6 weeks for a vaginal birth but 8 weeks for a c-section . Disability I believe is the family medical leave act and you dont get paid for that or get a portion of your salary depending on your company.

You can file for short term disability with NY state through your company - your HR person should be able to help you with that. 6 weeks full pay is great!

thank you. Ok so i should have it all set up before i leave so that it kicks in the day my full pay leave ends? Can I do that?

Def fill out the forms and stuff before you go out on leave, ask your HR person what the procedure is. I havent gone through it just yet either but I know your job will help you file for STD through the state.
ETA and you will get partial pay for an additional 6 weeks on top of the 6wks you get at 100% pay - afteter that, you are entitled to FMLA but thats without pay. YOur HR person can help you with all that.

Also, I was told FMLA runs concurrent with STD they both start at the same time. It can take up to 30 days for STD to kick in.

well the thing is we are a small company under 50 employees so the FMLA does not apply.

are they going to hold your position? Without FMLA they can terminate your employment.

My job just gave me this form for my doctor to fill out that I then had to send onto the insurance company my company used. Then the insurance company sent me an additional form for my doctor to fill out after the baby was born. I got all 6 weeks paid in one lump sum.

My company offers 6 weeks paid for natural birth - but disability is taken before the birth - not after...not sure what type of disability would apply after you give birth but wanted to mention that you can be offered 12 weeks unpaid personal leave - and under state law you should be given your position back or a position which pays the same salary. Of course, you can take more time off - but the state protects your position within the company for 12 weeks or more if you have a supervisor consent.

One of our clients I do bookkeeping for who we also share an office with had someone who went on maternity leave. I gave her the phone number of the company I pay the disiblity to and they faxed her a form. When she received the form she filled out a portion, her doctor filled out a portion and then I had to fill out a portion since I also do their payroll. Once I was done with it and had her boss sign it I mailed it to the disability company. I am concerned since I also work for a small company and I do all that stuff for our company that no one will send it out for me. I recommend getting the phone number from your companies bookkeeper. They either pay the bill quarterly or annually and they should get an invoice for it.

The remaining disability is from New York State....it is $170 per week at the top end. It is very generous that your boss has given you 6 weeks of full pay. Of course your health insurance is still in effect during that time. You also have 30 days from the date your child is born to add him/her to your insurance coverage.

I mayb be wrong but I thouht disability was only for the first 6 weeks (the ones you would be getting paid for). I didnt think you count as disabled after the first 6 weeks.
