Do you rent an apartment?? Please help...
Hi everyone. Please help me. My mom passed away last month and she took care of our rental properties so this is all new to me. I have four apts above my business. Last month 1 of my tenants said her apt. was cold. I called the boiler company and they came out and gave me a new boiler & hot water heater- that all came out to $6500. I thought everything was settled. So for the la 2 1/2 weeks that same tenant calls me EVERY single day, several times per day to complain about the heat. (No other tenants have said a word.)
Now this is were you come in:
I have a preschool on the first floor (commercial building). During the day I keep the heat between 68 and 70 which is extremely warm in the school. At 3 pm we go home I turn the heat to 73 to ensure the ppl upstairs are comfy. I am so aggravated w/ this one tenant that today I proposed that put a separate meter for her apt so that she can control her own heat. She didn't like this idea. My whole thing is out of all 4 apts this woman is the only one home during the day. Why can't she put on a sweater? That is what I do in my house. There have also been times when I get to work in the am and look up to her apt and see the windows OPEN!!!
How does it work in our apt??? Do you pay for your heat and can you control it?
Please help! My lawyer is gone for the day and I need help.

we have our own heat and we pay for it ourselves.
I'm thankful - we've always had it that way - i every apartment i've ever lived in.

See another thing is that my mom NEVER raised anyone's rent - now that I pay all the bills I see how much it costs to heat the buildings--YIKES! I am a good person and think about my tenants have great relationships w/ them. They have all occupied that building over 10 yrs. The rise in heating costs are crazy! I want to give the tenants their own meters now b/c just seems like a lot less of a headache for me and then I wouldn't raise their rent.

well i rent apt i live upstairs i dont control the heat. my landlord is always playing with the heath and im always calling her to tell its cold and i have tile falls so its much colder then it really it is. i much rather control my own heat because now they put the heat on its like 100 degrees in my apt. so its never comfy. its either to hot or to cold. i rather have heat then freeze if im paying almost 1200 a month then the heat should be on no matter what. so as long as she leaves it alone i wont bother but if she doesnt i will call her and complian. im not sitting in a cold apt while paying rent. but my landlord is to cheap to put another meter in i wish she would

UPDATE: My lawyer just called me back and said that I need to give her a separate meter and a thermostat. This way everyone can be happy and not only can she control her own heat she can pay for it too! Thanks for your help.

where is the apartment??
New york city law says you only need to provide heat between certain hours and when it is a certain temp outside
i'll see if i can find it
here it is:
a landlord must provide sufficient heat to maintain apartments at 68 degrees Fahrenheit between 6 a.m. and 10 p.m. when the outside temperature falls below 55.
Between 10 p.m. and 6 a.m., she said, heat must be maintained at 55 degrees when the outside temperature falls below 40 degrees

Thats exactly what the lawyer just said ad I HAVE been maintaining but also dong better than that :) I cant wait til this is all resolved. Some ppl dont appreciate what they have til its too late!
