Don't know where to post this but...
Hearing about deaths that are occuring at a young age really has me thinking that DH and I should make a will and make sure that our Son is taken care. The main thing is to appoint a Guardian to our child in the event that something should happen to our child. How do I go about doing this? Just go sit down with a lawyer and talk about it?

You should definitely have a will and guardianship with specifics drawn up. Contact a lawyer and they will guide you through. They will probably do a heath care proxy at the same time. For some people the biggest thing is who will be guardian. Our choice was very easy but I know some people struggle with it.

Re: Don't know where to post this but...
We did the 4 major document right when DD was born... Me and DH decided who we wanted as guardian and also picked a backup just in case... We also spoke to those people to make sure everyone was on the same page...

Our choice is easy. But now before you do anything should you ask the people that you are thinking about appointing as Guardians?

I'd definitely ask them just to make sure there is no question that they are OK with it. Of course we make these decisions hoping that we never have to utilize it but in the case you do, you want to know they are 100% on board for the job.

Oh a backup...that's a good idea. I was thinking of listing one more than one choice but then thought it would be too confusing as to who would have guardianship. But I guess if you spefically state who gets guardianship first and who is the backup then it shouldn't be confusing.

Yes, you have to ask them.
You should do this ASAP. Our will and guardianship papers were done when DS was only 2 weeks old.

Contact an attorney, preferably an estate attorney and they will tell you what documents you need. At the very least, you should have a will, a durable power of attorney, a health care proxy and a living will. FM me if you need a referral. I have a wonderful attorney in Manhasset.

Do we need an estate attorney even if we don't have property? We rent an apartment and don't own any property. All we have are our savings accounts which would go to DS of course.

an estate attorney specializes in wills, trusts, estate planning, etc...has nothing to do with owning property...

Also you should consider life insurance if you don't already have it.
DS shouldn't get the money if he is a minor- you'll need to appoint someone to be in charge of his money until he can take possession of it.
It's smart to appoint someone guardian of DS & another person guardian of his money.

This is one reason you want to use an estate attorney instead of any old attorney. You don't want cookie cutter documents...you want them to fit your specific needs.
