Down Tree in our Yard
Well one tree is down in our yard. Well it's not completely down, but it has to come down at this point. It's pretty much in our yard at this point. But no damage to our ugly fence. (darn it) We want a new fence.
Our biggest problem is that it's on wetlands property, but we do pay the taxes on the property. It is our property. But we need to call the DEP to take this tree down technically. But it also in our yard, so from our understanding from the Village we are aloud to take the tree down that is in our yard over the fence. So weird. We pay for the property, but we can't take the tree down technically.
But the birds are out.

We've had the same situation. You can cut the tree a little behind the fence, and then the base of it will fall in the wetlands and the rest in your yard. Then you can just cut up the part that fell in your yard. There are a lot of trees like that in the wetlands behind my house but not over my fence and the DEC just leaves them there.

Thanks. I think I might just call the Village and tell them what happened and tell them that we will be cutting it down. I don't want anyone telling me we did something wrong and then fine us or something. It's like tip-toeing around the wetlands.....what can you do, what can't you do. It's crazy sometimes. But I don't understand.
