Whose tree is it????

Would a tree that is on the other side of your sidewalk next to the street considered yours or the towns? Just curious because the roots are bringing up the sidewalk. So is it our responsibility to remove it or the town?

We live in Town of Hempstead. We are responsible for maintaining the tree (trimming, etc) and so I guess we'd be responsible for the removal. I know that you can request the town plant a tree in front of your house for free, it took them about 6 months after my mom asked to plant 2 in front of her house.

This is what I think - It's the town's tree but unless it is dead or dying they will not remove it. If you want it gone than you need to tell the town, get the OK from them. Pay to have it removed and then the town might ask you to plant a tree to replace the tree you took down. Not sure if it has to be in the same location.

Unfortunately I think you are responsible, including the sidewalk in front of your house. Next door is the corner property so they have a lot of sidewalk surrounding their home. They were telling us they have to replace it, because it is in bad shape and they don't want someone to trip.

In western suffolk it is the TOWNS tree not yours...!!!
You can't do anything to it!

I would call up your town, explain what's going on and see what they will and won't do to correct the situation.

Call the town to make sure. Town of Huntington it would be considered the town's property and tree.

Plus, they will fine you if you trim it or remove it.

Definitly check with the town before you do anything with it. There are some areas where you could get fined for touching town trees.

We bought a house in Oceanside. The rerason I ask is because the tree is leaning over toward the house and completely blocks the entire front of the house. When you look out the front window all you see is tree. And most importantly the roots are bringing up the sidewalk which could be dangerous if someone falls.
