Engineer Inspection Report
So, we got the engineer inspection report today with the recommendations he would make on the house before we buy it.
So, what do we do with it? Discuss it with out lawyer and see if the owner's will make the recommended changes before contract, or do we make them part of the contract? HELP!

Talk to the lawyer about what you want done - he will try to negotiate with the seller's attorney before the contract is drawn up. If anything else comes up when you go to sign, you can have those changes put into the contract.

You have a few options:
1) take the house as is and keep the report for future repairs to be paid for on your own. This depends on if the work to be done is major like a roof leak, electrical issues, plumbing issues. For major work I would not suggest taking the house as is.
2) ask the sellers to make the repairs at their expense before closing
3) ask the sellers for a concession for you and DH to use pay for the work. You can ask them to give you and DH enough to pay for the entire estimated expenses for the repairs, half the estimate or any other amount you want to request.
So far #3 seems to be the most typical since most sellers are leaving the area and do not want to worry about finding and hiring contractors.

I would choose #3 if it were an option because that way I would know the work was done, and done properly. My brother just had a problem with his chimney - they were told the previous owner would clean it before they left. It wasn't cleaned and after the chmney went on fire, my brother had to call someone in to clean and check it for him.

I would go with # 3 as well.
But definitely show it to your lawyer, he/she should be able to point you in the right direction.
It also depends on what needs to be done.

the only major thing that came up in the report was the roof was leaking in the garage.
and they cant find the remotes to the garage opener
so they had an estimate done - since the sellers live out of the country - FH and I met the roofer at the house -he actually worked a little more in the quote to fix the whole roof (its old, but he said he can get us a few more years out of it) and fix some mortar on the chimney. so we are having him fix it, since we met the guy.
and they are giving us a credit for the remotes, bc the poor sellers agent would probably have to go buy them, and I dont want to trouble her.

At least 80% of the Buyers I have dealt with take the money and find their own contractors. I personally have never bought a property and let the Sellers make the repairs. You never know if they used licensed contractors, got the proper permits or did the work on their own.
Now that I deal predominantly with commercial property leasing I see that many owners use handymen to make repairs rather than licensed specialist. It's safer to take the money

If you can, try to negioate without getting the seller's lawyer involved, well...depending on what needs to be done.
I told my lawyer about the engineer's report and was told that since everythign is in working order, the sellers are not required to do anything. The seller's attourney will know this, but the seller may not.
I know it sounds sneaky but you have to look out for yourself.

We spoke to the engineer about it and he told us to make sure they fix the major things or make a concession in the sale price. He also told us not to worry about minor things because it can end up putting off closing. We ended up having the sellers repair the roof, meter box and siding repair. The rest of the stuff we didn't worry about.
