Excess / re-hire question

Can anyone help me figure this out - if you were excessed last year (as a .4) and this year your school posts a full-time job in the department, should you be given first right of refusal? This is for a LI school, if it matters. Any insight is greatly appreciated!!!!

ETA: I'm actually asking for my DH. He's been jerked around at his school like crazy and they are n the process of pulling the rug out from under him again now and I just feel so at a loss and completely helpless. If I went into the whole story you probably wouldn't even believe it. Anyway, I'm wondering if anyone has any advice. TIA Chat Icon

In my building all teachers were called back for 7 years for any open positions, but they were full-time and it was written in the contract. It would depend if it's in the contract for teachers and if it applies to positions less than 1.0. Were you a contract employee at .4?

I'm going to meet with my union rep tomorrow but basically the first year in this dept I was a .7 (and .3 TA), then .4 the following year (.6 TA). Then this year I'm fully TA because the enrollment dropped. Now next year they have a 1.0 and I'm wondering if I'm at all entitled to that position!

I would think it depends on the wording of your contract. I was a full time employee and have been called every time there has been an opening.

I was excessed from my first LI district so feel free to PM me. Under the law, if you're excessed from a full-time position in one tenure area then you are on a preferred eligibility list (PEL) for 7 years during which time you must be offered any position that opens in your tenure area. Since your DH was excessed from a part time position then he's probably not on the PEL. If he's currently a 1.0 TA then he should be in a probationary position because teaching assistant is a separate tenure area.
