for buyers who let the owners stay a few days after the closing...

You still got the keys at closing, right?

Not necessarily. My friend just sold her home and stayed five additional days after the closing. The new owner arranged to pick up the keys as she was leaving. I don't know if that is standard but I would want to make sure I got that last set of keys, even though I would change the locks shortly after moving in.

Thanks! I guess it can go either way.

I'm definitely planning on changing the locks after they move out. I don't want to deal with having to try to meet up with the seller to get the keys. She's moving out mid-week and we work long hours in Manhattan. Our landlords have keys to our apartment, shouldn't we have keys to the home we technically own?

I'm just curious... I will be asking my lawyer when I speak to her later. I just wasn't sure what to expect.

I guess it could go either way!

We closed on Tuesday and they moved out on Friday.
We had a walk through before the closing. Then I met the sellers at the house on Friday and did another walk through to inspect damage wasn't done by the movers.
I got the keys then.
I then had to call my lawyer and tell them everything was ok and they released money in escrow that was held for this particular reason.
They also had to pay me rent for the four days they stayed past closing. They wrote us a check at closing.

Yeah, I completely understand that aspect of it!

Technically, though, we're their landlords, strangers or not. That was the only reason I thought we may be entitled to get them sooner.

Looks like I'll be missing even more work than I thought. Oh well. *sigh*

Not a big deal. I just wasn't sure how these things go.

You are their landlord, and should, imo, have a set of keys. They will also need a set until they move out. If you are not that worried about damage, and frankly a lot of damage is not that visible, ask them to FedEx the keys. As long as your lawyer doesn't release the escrow, you should be covered.

I do agree that we should have the keys. I just wasn't sure how it should work or how it workeed in other situations.

I definitely think I will request them and see what happens. I'll let my lawyer know today when I speak to her and see what she says. I was planning on doing this anyway, but wanted to know what to expect.

I am not waiving our right to inspect the premises after they move out before we release escrow. I'm not *that* worried about damage, but with some of the stuff they're put us through, I'm not about to be stupid about things. I also want to make sure they move ALL their stuff (man they have a LOT of stuff!)

our seller stayed in the house an extra 3 days after the closing and I went and did another walk through when I picked up the keys. That is the best way to do it. Another thing that can be done is that maybe you can have the broker pick up the keys and you can get them from them later in the day after work and then do the walk through so that you can still do the walk through and then tell your attorney that all is good to go.

We won't get the keys until we take possession. No biggie.

After the walk-through last night, I'm no longer too worried that she'll overstay or anything. She was practically all moved out. Even most of the furniture was gone already!

We let our sellers stay in the house for about 4 extra days and we did not get the keys at closing. We just met them at the house when they were all moved out. We also didnt charge them for staying and they didnt charge us for the oil in the tank and some other stuff.

Both when we bought the coop and then when we bought the house the previous owners needed a week to stay in the house. Both times we got the keys at the end of the time they needed...never at closing. I was fine with that - didn't want keys to their house while they were still there because I didn't want to be responsible for anything or any accusations...KWIM?
