Girls who work for small companies (less than 50 employees)
Are you getting 12 weeks maternity leave?
My boss had the nerve to say to me "oh you're going to be out for 6 weeks?...that's what I get for hiring young women"
Yup - he did!
So I explained to him how everyone I know gets 12 weeks. And I reminded him that I was not getting paid during that time.
They don't have to follow the FMLA because it it is a small firm, but I was wondering if anyone else who works for a company of less than 50 people, is being given less than 12 weeks (whether paid or not).
Don't get me wrong, I am greatful to have a job during these times. I feel badly complaining about my job when so many people have been let go of theirs, but I have been growing a little bitter about how my bosses have been handling my maternity situation.

No, he doesn't have to give you any type of leave past the 6 or 8 weeks that you are legally disabled by NYS.
When I was pregnant I worked for a small company and I was not entitled to FMLA. I currently work for another small company and it is the same.
This is not a flame, but just bc "everyone you know" is taking 12 weeks doesn't mean your boss/company has to give it to you.

Thanks for the response.
I know that they don't have to give 12 weeks if they employ 50 or less. Just wondering whether anyone's job is giving them 12 regardless of whether they have to.
From talking to different people, it seems pretty standard to get 12 weeks regardless of the size of the company (not all paid of course).
oh and telling my boss that "everyone I know" gets 12 weeks was just my reponse to his inappropriate comment about me taking maternity leave.

Trust me, I understand, I had the worst boss when I was pregnant
But you have friends with nice employers, b/c most people I know get the 6 or 8 weeks

Thanks that makes me feel a little better, but at the same time I left a big company to work at a smaller, more "family friendly" place.

As of right now I am taking the 6-8 weeks allowed by disability. I have not discussed anything further time off with my boss bc he is away at the moment. If I do take any other time, it will be my saved vacation time.
But honestly I would not expect anything more then the time allotted by NYS Disability. This is one of the disadvantages of working for a small business.

Most of the people I know/knew who worked for small firms did not get 12 weeks (paid or otherwise). They were even given a hard time for taking the 6 or 8 weeks. Unfortunately it is definitely the down side of working for a small firm/company.

I work for a company of 4 people, but I work from home, so I'm in a little different situation. I'll probably start working from home again after 4 weeks or so.
Is working from home for a few weeks an option for you after the 6-8 weeks?

My company does not even offer maternity leave. They basically give you a hard time before the baby comes and then after.... This is why I am not staying. We are going to try to just have me stay at home, but if it gets too tight financially, I will look for something at night.

I'm on maternity leave right now. I ended up being taken out of work 1 month early and placed on bedrest. My return date hasn't changed. I'll end up being on leave for a little over 4 months.

the disability from the state is a small fraction of the regular salary....

My company is small and not subject to FMLA. When I requested my maternity leave, I just asked for 3 months and they said fine. Mine isn't paid at all -- I am using accrued vacation/sick time and that gives me a little over a month paid.
I would suggest just going back and asking if you could take more time.
I'm sorry he's such a discriminatory butt face

This isn't legal. In NYS you are legally disabled for 6 weeks (v-birth) or 8 weeks (c-section)

I work for a small firm that is not subject to FMLA. I am taking 12 weeks but am not sure how much they are going to pay me for - they said they were going to find out what is the standard (and quite honestly they'll probably do a little better) and give me that...

Are you eligible for FMLA? If not, and you planned on going back to work as soon as the 6 or 8 weeks of disability ended, but no position was available, you would essentially be laid off. You need to check with the NY Department of Labor, but I think you'd be eligible for unemployment.
