Heath Insurance Question- New Job
My DH recently accepted a job offer with a new company, and will be starting at the end of the month. Our health insurance is through DHs current company (my company does not offer health benefits). DH is not entitled to health insurance through his new company until after 90 days. So there will be a 3 month gap between coverages.
Are we required by law to obtain private insurance for the interim? Is that what the new law with obamacare and the health exchange states? I can not find any clear information regarding the laws or penalties if there is a lapse in coverage.

It's usually retroactive (at least it has been in my experience). Have him call HR or whoever handles the benefits to find out how it works.
Also, find out about the current coverage you have with the former job. Some places drop you the last day of work, other plans will cover you until the end of the month.
I read online that you can go up to 3 months without getting penalized for not being covered under the Affordable Care Act. Not sure how accurate that is, maybe others know more. Another option is COBRA.

I would get Cobra. While its expensive, I would NEVER risk being without health insurance. One trip to the ER (even for something not life threatening) could set you back $$$$$.

Agreed. DH accepted a new job while I was pregnant (very pregnant) and had 1 month gap. He negotiated for the new company to reimburse us for the cobra, which they did. Thank God we did that. Besides having the piece of mind, I ended up delivering less than 1 week after the new insurance was active, one week earlier and I would have been in big trouble if we didn't have cobra!

Cobra has a 60 day period for sign up. So technically you have to do nothing. If you break your leg on day 45 you just back pay. Does that make sense? It's what I've always done before new insurance kicks in.

You should sign up for COBRA. If you have any existing medical issues, the new insurance company can refuse coverage unless you can prove no break in insurance. The cost of COBRA is minimal compared to having to pay OOP for a condition forever.

I think that insurance companies can't refuse you for pre-existancing conditions anymore. I think that was part of the healthcare reform.
