A dog has 3 chances to bite. That is the law in NYS. AFter the 3rd bite a dog must be muzzled and then if a 4th bite occurs, the dog is put down.
Now, in regards to the bite. An animal bite should never really be stiched up. There are many more bacterium in an animals mouth then drs could scrub out. Therefore, the wound is usually left open but covered, antibiotic cream and orals are used to fight infection.
Almost 6 years ago, I had my ring finger almost ripped off by our dog. Luckily, got the er and they were able to save it. No stiching done until almost 3 weeks after the skin started to grow back and then they reconnected the tendons, muscles, etc! I have a fully functioning finger!

I think someone has to file a complaint in order to have you euthanize the dog. I remember when that woman was attacked by those 2 pit bulls the owners were fighting with the town in court to keep the dogs alive so unless your stepdaughters mother makes a stink you will most likely just have to show a record of shots for the dog.
The hospital can put in a complaint as well.

UPDATE in first post:
UPDATE 7/18: She got 12 stitches! DH brought the dog's collar with him to the ER to show them he had his current rabies shots. They told him HE has to call the health department and report it, not them...which is silly because we are not going to report our own dog. If the police come to us, then we will have all the paperwork necessary, but we are not making the first move. Apparently....she wasn't playing with the dog....she was supposed to be sleeping (after 9pm), and DH was down in the basement sleeping on the couch with the dog while he was waiting for the laundry to be done. The dog was fast asleep. She snuck downstairs, and she tried to move him (probably to get him to come upstairs with her) and he got startled so he snapped at her (which he has never done before...but again, when he's sleeping, nobody usually bother's him).
I just spoke to DH...she's still asleep as they didn't get back fro the ER until 3 AM. He is going to keep her home from camp for the rest of the week, and she has to go see the plastic sugeon on Thursday.

oh sweety i am sooo sorry that this happen. usually they hospital calls, so do don't be surprise when this goes threw higher people in the hospital and they call. i hope she get's better soon!

i hate to say this is not true, in most cases! as for your finger to the baby's bite, yours was so bad and that is why they did not stich you. i was bit in 3 places and got stiches right away(my own fault, never try to seperate a dog fight by yourself) i did get a call and had to show all the proof of shots or repeat them, plus if i did not they would have taken my dog. and i could have gotten a fine. again your dh did the right thing in bringing her to the er and getting the stiches, and bringing the coller also. just do not be surprised if in a week or 2 they call you to double check the licence number is good. i would also bring the dog to the vet to get a temper shot, and to make sure the dog might not be sick in some way. he might be sick or have an injury that you do not know about that could have caused him to act in the way that he did! again good luck with the dog and i hope the baby feels batter real soon!

Really I wish i would have know this a few months ago. Plainview hospital reported every time my friend's pit mix "nibbled" at him or his mother (he was teething at the time). Once they came in for the 3rd incident the Town got involved & took him to put him down
I am glad to hear that you were able to save your finger...that is unreal!

I don't believe they will take away the dog. My sister's girlfriends dog bit her 2 year old son and she CHOSE to have the dog put down (the dog was very old) but I don't believe they MADE her do it

I guess I am the only one... but I would not want that dog around my baby once I gave birth. Babies and toddlers aren't always "Easy" on dogs and I'm sorry but once it bites a child once there is a good chance it will happen again I hope you at least get some type of training for this dog .
And how can any parent even hesitate about taking your child to the ER when it is clear they need medical attention, for fear they will take the dog is no excuse! Your childs health and safety comes first . I'm sorry but that part made me very upset and sick to my stomach!!!
ETA: I am sure your step-daughters Mother would NOT be happy to hear that your husband hesitated getting their daughter medical attention even for a second for fear of having the dog taken away. That is appalling!!!! If I were the girl's real mother I would have a serious issue with my Ex husband over this situation.

New York state has mandatory reporting laws for dog bites, but it doesn't mean that they are going to take the dog away. I believe if you can show that the dog has its immunizations, does not have a history of biting, and the injury is not life threatening then they wont take the dog. My mom got bit by a dog and the dog was reported and not taken away. I am glad to see that your daughter got the proper treatment, I hope she is feeling better

YES IT WAS NECESSARY!! Many people have fm'd me saying they agree with it but I guess they choose not to post it. Sorry but someone had to say it.
There are lots of times as a parent you are scared/upset/don't know what to do. But you don't just sit around while your daughter has a deep cut in her face deciding on if you should go to the ER or not. You GO and have your daughter taken care of and worry about the dog later.
As a parent I can honestly say worrying if the dog would get reported or taken away would be the LAST THING on my mind.

I agree with Mable 100%. I read that thread last night and the first thing that came to my mind was that they were putting the dog before the child - I didn't understand it at all. However, I am not a parent, so I didn't feel it was my place to respond. I was really surprised it took until page 2 for someone to bring it up.
